Market consultation pursuant to Section 197 of the Federal Procurement Act 2018. In a first step, companies interested in participating in this market consultation are invited to express their interest in writing by e-mail to Mr Robert Ziegler (Robert.Ziegler@pv.oebb.at) no later than 30.09.2026. In a second step, interested companies will receive a service description containing the technical requirements for the respective modules or systems of the subject matter of the contract. Expressions of interest from companies that can provide only part of the delivery items or services in question are not permitted. Rail Equipment GmbH & Co KG reserves the right to enter into the market consultation exclusively with companies that can demonstrably meet the prerequisites described in the service description. For further details, reference is made to the service description, which will be sent by e-mail to Robert.Ziegler@pv.oebb.at upon request after interest has been expressed. In addition, a questionnaire will be sent, which must be answered by the end of the following deadline. The completed questionnaire must be submitted by e-mail to Robert.Ziegler@pv.oebb.at no later than 30.10.2026. After the market consultation deadline has expired, ÖBB may invite interested companies to non-binding industry discussions or dialogues. These discussions serve exclusively for the objective discussion of market information, technical concepts, innovative solution approaches, and the assessment of implementation, scheduling, and risk factors in connection with a possible future procurement. Participation in the market consultation and in any industry discussions is voluntary and does not give rise to any entitlement to an invitation, participation in a subsequent procurement procedure, or the award of a contract. In particular, participation in the market consultation or information obtained from it does not give rise to any rights to equal treatment, protection of legitimate expectations, or conclusion of a contract. This market consultation does not constitute a notice, an invitation to submit tenders, or part of a procurement procedure. ÖBB may use the information obtained in the course of the market consultation while observing the principles of procurement law, without this giving rise to obligations to conduct a procurement procedure or to structure such a procedure in any particular way. ÖBB expressly reserves the right to: – adjust or terminate the content, scope, and course of the market consultation at any time, – discontinue individual or all industry discussions, and – refrain entirely or partially from initiating a procurement procedure. Reimbursement of expenses or costs incurred by companies in connection with participation in the market consultation or industry discussions is excluded.
