The purpose of the framework agreement is the provision of services relating to the maintenance and repair of ISSeP laboratory equipment. Description of the services to be performed: it will cover the following services: maintenance, troubleshooting, technical interventions, and spare parts for all the equipment in the inventory described in the various lots. These services fall under CPV codes: 50410000-2; 50000000-5. This is a framework agreement for services in a sector sensitive to fraud: NO. All terms governing the framework agreement are set out in these special specifications. The framework agreement will be concluded with a single contractor. The arrangements relating to the conclusion of contracts awarded on the basis of this framework agreement are set out under “Procurement and award of subsequent contracts” below. The tenderer shall complete the inventory entitled “Annex 2,” attached to these special specifications. It shall enter the required information therein and perform the necessary arithmetic operations. The tenderer must respond to all items in the inventory for a lot. Failing this, its tender will be declared irregular and therefore excluded from the lot in question. A tender that is incomplete with regard to a lot will result in the exclusion of the tender for that lot. The contracting authority reserves the right to award only certain lots and, where applicable, to decide that the other lots will be the subject of one or more new contracts, if necessary using another procurement procedure. You may submit a tender for all lots. You may offer discounts or improvements if several lots are awarded: NO. Variant(s): This contract does not include any authorized, required or free variants. You may not submit a variant. Free variants are prohibited. Any variants proposed will not be taken into consideration. Any options proposed will not be taken into consideration. Tranche(s): The contract is not divided into tranches. 1.1. Services required for equipment maintenance Tenderers are requested to complete the tables in Annex 2 – Inventory. The tenderer shall propose two types of maintenance contract, namely the preventive maintenance contract and the comprehensive maintenance contract. a) Preventive maintenance contract: the tenderer must make every effort to keep hardware or equipment in good working order and prevent damage or breakdown. The price will be determined on the basis of one annual or multiannual visit. The required number of visits per year is specified in the “number of annual visits” column in Annex 2. Travel, labor, and all products and parts that must be replaced during preventive maintenance are also included in the price tender (for example: oil, lamps, seals, etc.). Likewise, all consumables required for preventive maintenance will be included in the price. During performance of the contract, if the contractor wishes to invoice for a consumable, it must provide evidence in a note that this consumable is not required under the preventive maintenance contract. For all equipment, tenders shall include the list of products and parts required for maintenance. b) Comprehensive maintenance contract: this arrangement includes annual preventive maintenance performed by the manufacturer. The required number of visits per year for preventive maintenance is specified in the “number of annual visits” column in Annex 2 – Inventory. In addition to the planned preventive maintenance, telephone support and as many visits as necessary, provided within two working days in the event of equipment failure, are required. Working hours, travel and accommodation expenses, and all parts required for the repair are also included in the price tender. 1.2. Services required for equipment repair under a preventive maintenance contract In addition to the elements listed under point 1.1, a) above for preventive maintenance, the contracting authority provides, under this preventive contract, for a corrective option in the event of a breakdown. This preventive maintenance contract with corrective option must include: - the hourly price for a repair; - the flat-rate travel charge for a repair; - the price of spare parts when these are provided for in Annex 2 – Inventory. Technicians qualified for maintenance and repairs shall be trained and recognized by the company that distributed or manufactured the equipment concerned. The contracting authority requires the certificate of authorization or competence of the technician concerned, obtained after training within said company, to be provided in the tender. Throughout the term of the contract, the contractor shall guarantee a sufficient and stable workforce of qualified technicians capable of performing the contract. In the event of a change in the qualified technicians assigned to the contract, the contractor shall, at its own expense, provide replacements through technicians with equivalent competence, authorizations and/or aptitudes. At the same time, the contractor shall immediately notify the contracting authority by email and shall provide it with the replacement technician’s certificate of authorization or competence obtained after training within said company before the technician takes up duties. · In all circumstances, the periods required to familiarize new technicians and the related costs shall be borne entirely by the contractor, as shall delays incurred in relation to the planned services. The contracting authority reserves the right to accept or reject the proposed technician. Under no circumstances may the contractor invoke a change of technician to evade any of its obligations. Furthermore, the contracting authority may also require the replacement of technicians assigned to the performance of the contract when they clearly do not possess the required skills, authorizations and aptitudes. The contractor shall be required, at its own expense, to replace them with technicians possessing the required skills, authorizations and/or aptitudes within 15 working days of the reasoned notification by the contracting authority, following the same process as detailed above. If agreement on the new technicians cannot be reached within five working days from the announcement or request for a change of technicians, the contracting authority expressly reserves the right to terminate the contractor’s assignment unilaterally, without being liable for compensation. The tenderer must also guarantee or provide the following: o the technicians must speak French and/or English, to the exclusion of any other language; o a detailed document stating the number of after-sales service technicians must be provided; o the spare parts and consumables supplied shall be original and recognized by the manufacturer of the instruments covered by the tender. No compatible spare part or consumable will be accepted; o the tenderer must guarantee a substantial stock of spare parts available quickly; o telephone support (helpdesk) must be free of charge. 1.1.
