Belgium – Technical inspection and testing services – FRAMEWORK AGREEMENT - APPOINTMENT OF APPROVED EXPERTS IN CONTAMINATED SOIL MANAGEMENT FOR CARRYING OUT SOIL STUDIES, MONITORING REMEDIATION WORKS AND PREPARING SOIL QUALITY REPORTS

Comment: The contract is aimed at concluding a framework agreement within the meaning of Article 2, 35° of the Law of 17 June 2016. It aims to establish a list of expert firms that may be called upon by the contracting authority. The maximum number of tenderers that will be selected is three. The purpose of this contract is to appoint approved experts in contaminated soil management to perform, in particular, the tasks provided for by the Decree of 1 March 2018 on soil management and remediation and the tasks provided for by its implementing orders. The tasks will include carrying out orientation studies (including preliminary studies), characterization studies (including risk studies), remediation projects, supervising land remediation operations and works and carrying out final assessments, as well as preparing soil quality reports (RQT). Tenderers may also be called upon to draft notes interpreting analysis results for internal use. These studies will be conducted on behalf of SPI and/or its subsidiary SORASI. They may also be conducted on behalf of municipalities/institutions falling within SPI’s “Local Authorities” sector and for which SPI has been assigned a delegated project management role. The purpose of this contract is to carry out a series of investigations enabling the Contracting Authority to be provided with all information useful for an appropriate understanding of the contamination status of land (or evidence making it possible to substantiate the absence of contamination), as well as to inform it of any measures to be taken with a view to the environmental rehabilitation of the site in connection with the implementation of the planned projects. Where applicable, the selected approved expert must incorporate existing results into its studies, insofar as possible (ISSeP studies or other studies conducted previously). The studies covered by this contract must be capable of falling within the framework of the Decree of 01/03/2018 and must be carried out in compliance with the Walloon Code of Good Practice (CWBP) and the Walloon Compendium of Sampling and Analysis Methods (CWEA). If the Administration (Soil Remediation Directorate - DAS) requests additional information following the submission of a study under the Decree of 01/03/2018, with a view to obtaining a study compliant with the CWBP, no additional fees may be requested. In the event of a change in legislation before the end of the contract, the tenderer will be required to comply with the Administration’s instructions as to whether the task may continue under the previous regime or must comply with the new legislation. If substantial changes attributable to the change in legislation are required by the Administration, the arrangements for continuing the task will be agreed between the tenderer and the Contracting Authority. The Contracting Authority will select the three tenderers that have obtained the three highest final scores according to the method set out in point I.10 Award criteria. For each new case, the contracting authority will award the tasks to the participants in the framework agreement, without reopening competition, in ranking order and while ensuring a balanced distribution of the tasks among them. The conclusion of this contract does not grant the service provider any right of exclusivity. SPI may, even during the contract’s period of validity, have services identical or similar to those described in these special specifications performed by other service providers.
