1.Type of procurement: purchase 2.Name of the goods: •A95H gasoline •B6 diesel motor fuel 3.Quantities: •A95H gasoline- 53 850 liters ±10% •Diesel motor fuel- 291 242 liters± 10% 4.The price is determined on the basis of the price at the Seller's filling stations on the day of refueling, with a discount from the price including VAT per liter of fuel. The price includes transportation costs, customs duties and levies on the fuels. The fuel price is paid under deferred payment terms through the use of a system for registration and authorization of purchases/cashless payment/. 5.Additional characteristic: the fuels offered must comply with the relevant standard requirements of the Renewable and Alternative Energy Sources and Biofuels Act and the Ordinance on the requirements for the quality of liquid fuels and the conditions, procedure and manner of their control, and must be accompanied by the relevant quality and quantity certificates (certificate of analysis, certificate of origin of the fuels, company technical specification for each type of fuel. The Seller is liable for damages arising from poor-quality fuels. 6.Packaging: bulk. 7.Place of delivery of the goods: the Seller's filling stations within the territory of Krivodol Municipality and the Republic of Bulgaria 8.Method of determining (measuring) the quantity/weight: It is carried out at the time the vehicle is refueled, according to the measuring device and the readings of the fuel pump, as well as a printout in written and/or electronic form reflecting the refueling. 9.Entry into force and term of the contract: The contract enters into force on the date of its conclusion and has a term of 5 /five/ years. 10.Franking: the Seller's filling stations within the territory of Krivodol Municipality and the Republic of Bulgaria. 11.Method of payment: The fuel price is paid under deferred payment terms and through the use of cards for registration and authorization of purchases/cashless payment/. For the quantities refueled, the Seller submits to the Buyer a monthly report listing the vehicle registration numbers, refueling date, type of fuel, quantity, price per liter on the day of refueling and the total price of the fuel supplied, including the discount. The report is submitted by the fifth day of the following month. Invoicing takes place once a month as of the last date of the respective month. Payment is made in euros by bank transfer. Payment is made within 30 days after the Seller issues an invoice accompanied by a monthly report. 12.Complaint period and method of settling complaints: Complaints identified at the time the vehicle is refueled at the Seller's filling station shall be settled within 3 (three) calendar days from the signing of an ascertainment report. Complaints are submitted by the Buyer immediately upon their discovery. The Seller is liable for damages arising from poor-quality liquid fuel – gasoline and diesel 13.Bank and other guarantees and securities for the SELLER and the BUYER: -The Seller provides a contract performance guarantee amounting to 1 /one/ % of the value of the exchange contract excluding VAT, in one of the following forms: - a monetary amount payable to a bank account of Sofia Commodity Exchange AD; - bank guarantee - original, unconditional and irrevocable, in favor of the Principal, in compliance with the requirements of the Public Procurement Act, with a validity period of no less than 30 days after expiry of the contract performance period; - insurance securing performance by covering the Seller's liability. 14.The Seller may block the issued cards in the following cases: •Upon termination of the contract, regardless of the grounds for termination; •Upon receipt of written notice from the Buyer that an issued card has been stolen and/or lost and/or damaged; •Upon three entries of an incorrect PIN code; •Upon exceeding the monthly limit specified in the Application for acquisition of the right of use; •In the event of delayed payment of an amount due under the contract or failure to perform any other obligation.
