The subject matter of the public procurement is a “supply” within the meaning of Art. 3, para. 1, item 2 of the Public Procurement Act (PPA) – supplies of goods carried out through purchase. Subject matter of the public procurement, technical specification and requirements: The subject matter of this public procurement is: SUPPLY OF HOSPITAL MATTRESSES UNDER TWO SEPARATE LOTS FOR THE NEEDS OF UMHAT “PROF. DR. STOYAN KIRKOVICH” AD The subject matter of this public procurement is divided into two separate lots: LOT No. 1 – Supply of anti-decubitus mattresses for the needs of UMHAT “Prof. Dr. Stoyan Kirkovich” AD LOT No. 2 – Supply of three-section mattresses for the needs of UMHAT “Prof. Dr. Stoyan Kirkovich” AD Each participant is entitled to submit one tender for performance of the contract for one, several, or all of the contract’s separate lots. No possibility is envisaged for participants to submit variants in their tenders. The maximum estimated value of the public procurement is EUR 35,395.00 excluding VAT, consistent with the financial resources of the medical institution. The maximum total value of Lot No. 1 is EUR 32,820 excluding VAT. The maximum total value of Lot No. 2 is EUR 2,575 excluding VAT. The stated value is the maximum financial resource determined by the Contracting Authority for performance of the public procurement, warranty service, and all components necessary for installation and, respectively, use. The Contracting Authority’s minimum technical and functional requirements for the mattresses are described in the technical specification attached to this documentation – Appendix No. 1. If anywhere in the stated technical requirements a specific model, source, process, trademark, patent, type, origin, or production is indicated, it shall always be read and understood as “or equivalent.” The Contracting Authority will accept an equivalent, with the burden of proving equivalence resting on the participant. The contract includes delivery and warranty maintenance of the mattresses. The products offered must be factory-new, unused, and not demonstration products. Participants in the public procurement award procedure must offer and deliver a medical device authorized for use, hereinafter referred to briefly as the “device/equipment,” within the territory of the Republic of Bulgaria in accordance with the Medical Devices Act (MDA). The offered “device/equipment” must meet all requirements specified for it in the Technical Specification, bear all necessary designations, markings, and other information in accordance with the legislation in force in the country, and be accompanied by all necessary documents in accordance with the requirements of Bulgarian and the relevant international norms and standards. The offered “device/equipment,” as a medical device, must have been placed on the market and/or put into service in accordance with the requirements of the Medical Devices Act (MDA) and must have: - affixed “CE” marking; - affixed batch/serial number, where applicable; - affixed identification number of the notified body, where required by the legislation in force; - affixed name and registered office address of the manufacturer and/or authorized representative and importer; - instructions for use; Time limits for performance of the contract: Delivery period – up to 60 calendar days after conclusion of a contract and receipt by the contractor of an assignment letter to carry out the delivery. The period begins on the day following the date on which the contractor received an assignment letter for performance of the contract. 1.2. Place of performance of the contract: UMHAT “Prof. Dr. St. Kirkovich” AD. 1.3. Tender validity period: 1.3.1. The tender validity period is 6 (six) months from the deadline for receipt of tenders. 1.3.2. The Contracting Authority may ask participants to extend the tender validity period until conclusion of the contract; 1.3.3. A participant will be excluded from participation in the award procedure for this public procurement if, following an invitation and within the period specified therein, it does not extend the validity period of its tender. 1.4. Method of payment: 1.4.1. Payments shall be made within 60 (sixty) calendar days after presentation of the CONTRACTING AUTHORITY’s Request and the following signed documents cumulatively: - Acceptance and handover protocol for delivery of the devices, signed by both Parties or persons authorized by them on the date of delivery of the devices; - Invoice issued by the Contractor and signed by the Contracting Authority or a person authorized by it, containing all legally required details - The period complies with the provision of Art. 3, para. 6 of the Medical Institutions Act 1.5. Contract term – the contract has a maximum term of 30 months, comprising: - a 16-month period within which the Contracting Authority may request the quantities under the contract up to the maximum quantities stipulated in the Technical Specification - a 12-month warranty period for each device, which begins on the date of delivery of each individual device and the signing of an acceptance and handover protocol for delivery - the proposed period for delivery of the devices The maximum total value of Lot No. 1 is EUR 32,820 excluding VAT The maximum total value of Lot No. 2 is EUR 2,575 excluding VAT Procedure: open.
