The subject matter of the public procurement includes the supply of TEMPEST equipment for the needs of the Ministry of Finance (MF), described in detail by type, quantity and technical characteristics in the Contracting Authority's Technical Specification - Appendix No. 1. The performance requirements are described in detail in the Contracting Authority's Technical Specification - Appendix No. 1, part of the public procurement documentation. The subject matter of the public procurement includes the supply of TEMPEST equipment for the needs of the Ministry of Finance (MF), described in detail by type, quantity and technical characteristics in the Contracting Authority's Technical Specification - Appendix No. 1. The scope of the procurement includes the supply of: - Computer configuration compliant with NATO standard – “TEMPEST SDIP-27 Level A” or equivalent - 1 unit; - Monitor – manufactured by the computer manufacturer - 1 unit; - Printer compliant with the “TEMPEST SDIP-27 Level A” standard or equivalent - 1 unit. The performance requirements are described in detail in the Contracting Authority's Technical Specification - Appendix No. 1, part of the public procurement documentation. *** *** *** The deadline for delivery of the equipment is up to 9 (nine) months, calculated from the date on which the Contractor is notified by the Contracting Authority that funding under the contract has been secured and the Contractor provides the specified performance guarantee, under the terms of the draft contract. The warranty service period shall be in accordance with the period proposed by the tenderer in its tender, calculated from the date of the respective delivery acceptance and handover protocol. *** *** *** The tenderer shall provide (its own or a Third Party's) warranty service facility for the delivered products, authorized by the equipment manufacturer or its official representative. *** *** *** If it is not the manufacturer, the tenderer shall be authorized by the equipment manufacturer or its official representative with rights to sell the offered products within the territory of the Republic of Bulgaria. The tenderer shall demonstrate its compliance with the stated requirement by attaching to its Technical Proposal an authorization letter or another equivalent document issued by the manufacturer or its official representative, in Bulgarian or accompanied by a translation into Bulgarian; Note: Where the tenderer submits an authorization letter from an official representative of the manufacturer, the tender shall also include the authorization letter issued by the manufacturer (or equivalent) authorizing the official representative of the manufacturer of the offered products with specified rights demonstrating that it is authorized to grant authorization to third parties for the right to sell the offered products. *** The authorization requirement at the tender submission stage is justified by the subject matter of the procurement and constitutes a guarantee of its timely and high-quality performance. If a contractor is selected and is subsequently refused authorization by the manufacturer, this may lead to a delay in the performance of the public procurement, as well as to its termination. According to the conclusions of the Supreme Administrative Court, “the authorization requirement in itself is not restrictive insofar as it is a guarantee of the quality and reliability of the activity performed. In ordinary commercial practice, authorization is granted on the basis of a contract, which may be directly with the manufacturer or with another economic entity authorized to grant authorization on behalf of the manufacturer” (Decision No. 10859 of 27.10.2021 of the Supreme Administrative Court in administrative case No. 6546/2021, VII division). In the documentation, the authorization condition is formulated broadly, i.e. it is not limited solely to the equipment manufacturer, but also includes any of its official representatives. General authorization is required, rather than authorization for a specific procedure, and every interested tenderer – partner, regardless of whether it is a Bulgarian or foreign person, is given the opportunity to submit a tender, with the opportunity to demonstrate the above circumstance either by means of an authorization letter or by any other equivalent document certifying compliance with the stated requirement.
