The subject of this procurement is: Selection of a contractor to exercise construction supervision during the performance of construction and installation works at the site: “Multi-family residential building in the town of Maglizh, 84 Tsar Simeon Veliki Blvd., identifier 49494.701.703.1, Maglizh Municipality, Stara Zagora Region”. The subject of this public procurement is a SERVICE and, pursuant to Art. 20, para. 1, item 1, letter “b” in conjunction with Art. 73, para. 1 and Art. 74 and Art. 99 et seq. of the ZOP, it will be awarded through an open procedure for selecting a contractor for the public procurement. The following activities are included in the subject of the procurement: Exercise of construction supervision: The Contractor is responsible for its activities and obligations as a participant in the investment process, regulated in Art. 166 and Art. 168 of the ZUT, as well as for those arising from Art. 178 of the ZUT. Construction supervision shall be performed within the mandatory scope in accordance with the requirements of the ZUT, the requirements of Ordinance No. 3 of 2003 on drawing up acts and protocols during construction, taking into account the requirements of Ordinance No. РД-02-20-1 of 5 February 2015 on the conditions and procedure for incorporating construction products into construction works in the Republic of Bulgaria of the MRRB, State Gazette No. 14/20.02.2015, and all statutory and secondary legislation in the field of construction in Bulgaria. Performance of the functions of safety and health coordinator. Obligations of construction supervision: 1. Is responsible for the lawful commencement of construction. 2. Checks the completeness of the construction documentation and the existence of all statutory requirements before commencement. 3. Certifies the construction site order book. 4. Is responsible for the proper drawing up of acts and protocols during construction in accordance with Ordinance No. 3/2003. 5. Shall monitor the progress of the construction and installation works in accordance with the builder’s schedule, assess delays and determine what measures must be taken in this regard. In coordination with the CONTRACTING AUTHORITY, shall order changes to the schedule or make decisions on such changes proposed by the contractor. 6. Performs the necessary inspections under Art. 169b, para. 1 of the ZUT of the construction products delivered to the respective construction site that are incorporated into construction works during their renovation, in order to ensure compliance with the requirement of Art. 169a, para. 1 of the ZUT, incl. performs checks of the conformity of: the technical indicators of the delivered construction products with the data in the certificates and protocols submitted by the builder from the control tests of the materials and equipment incorporated into the construction works, and their conformity with the safety standards and the technical indicators specified in the investment design. 7. Prevents damage to third parties and property. 8. Monitors compliance with healthy and safe working conditions (ЗБУТ). 9. Through the necessary inspections, measurements and calculations, verifies the types and quantities of construction and installation works actually performed at the construction site, which at the respective stage of project implementation are certified by the builder with an act. After the on-site inspections have been performed and conformity has been established, signs the act; 10. Shall require that all functional tests, commissioning tests and trial operation proving the fitness of the construction works for commissioning be conducted only in its presence, and shall control their correctness, completeness and lawfulness. 11. Controls the quality of the construction and installation works being performed and, through actions within its competence, prevents breaches of their technological sequence by issuing instructions and orders, which it enters in the construction site order book. 12. Shall control the proper maintenance of the construction site order book. 13. Shall provide the CONTRACTING AUTHORITY and any person authorized by it with access, at any reasonable time, to the documentation related to the services performed, for the purpose of carrying out inspections and making copies, during the performance of the contract and thereafter. 14. Shall issue instructions and make decisions on matters that do not lead to an amendment of the design and fall within the scope of the responsibilities of construction supervision. 15. Shall control the rectification of defects identified by it or by other control authorities. If the builder fails to intervene to rectify them, shall inform the CONTRACTING AUTHORITY and the Directorate for National Construction Control in writing. 16. In the event of a violation of construction rules and standards, shall notify the Directorate for National Construction Control. 17. Shall suspend construction work until the identified omissions and violations have been rectified. 18. Shall participate in commissions for conducting individual tests, 72-hour tests and comprehensive tests in accordance with the requirements of Ordinance No. 3 of 31 July 2003 on drawing up acts and protocols during construction. 19. Prepares a technical passport for the site in accordance with Ordinance No. 5 of 2006 on technical passports for construction works, with the necessary scope and content, before it is commissioned. 20. Prepares a final report to the contracting authority, in accordance with the requirements of the ZUT, after completion of the construction and installation works. In performing its obligations under this public procurement, the Contractor shall submit to the Contracting Authority a final report within the meaning of Art. 168, para. 6 of the ZUT for commissioning the respective construction works. 21. Shall also perform other obligations not expressly mentioned above but provided for in Bulgarian legislation and/or the requirements of the programme. Continues in Description (BT-24-Lot). Continuation from Description (BT-24-Procedure): Obligations of the safety and health coordinator: 1. Coordinates safety measures at the construction site. 2. Makes organizational and technical decisions to ensure safe working conditions. 3. Updates the Safety and Health Plan (ПБЗ) when the design is amended. 4. Coordinates the joint work of builders and subcontractors to prevent occupational accidents. 5. Organizes monitoring of compliance with safe-working rules. 6. Prevents unauthorized persons from accessing the construction site. Requirements for submission of the final product: The Contractor shall provide the Contracting Authority with: 1. An updated technical passport for the building for which construction supervision was exercised during construction—3 copies on paper and 1 copy on CD. 2. A final report to the Contracting Authority, in accordance with the requirements of Art. 168, para. 6 of the ZUT, after completion of the construction and installation works—3 copies on paper. In performing its obligations under this public procurement, the contractor shall comply with the requirements of: • Public Procurement Act and the secondary legislation for its implementation; • Spatial Development Act and its implementing acts; • Ordinance No. 5 of 2006 on technical passports for construction works. • Ordinance No. РД-02-20-1 of 5 February 2015 on the conditions and procedure for incorporating construction products into construction works in the Republic of Bulgaria (promulgated, State Gazette, No. 14 of 20 February 2015), effective from 01.05.2015. • Any other applicable legislation governing the performance of the activities that are the subject of this procurement. Note: In the event of a conflict between the provisions of the Technical Specification and a statutory instrument, the Contractor shall comply with the provisions of the relevant statutory instrument. Note: The Contractor shall coordinate with the Contracting Authority each of its decisions and/or instructions and/or consents to perform works leading to a change in the bills of quantities and costs for the construction and installation works being carried out. Time limit for performance of the procurement: The period for exercising construction supervision for the site shall begin on the date the construction site is opened and continue until completion of the construction and installation works, preparation of a final report to the contracting authority by the person exercising construction supervision pursuant to Art. 168, para. 3 of the ZUT, and commissioning of the site /issuance of a Use Permit/. The time limit for submitting the technical passport and final report is 20 calendar days from the signing of the Statement of Findings establishing the fitness of the construction works for acceptance /Appendix 15/. CONSTRUCTION CATEGORY: CATEGORY III, GROUP 1 LOCATION: town of Maglizh, 84 Tsar Simeon Veliki Blvd., ID No. 49494.701.703.1, Maglizh Municipality, Stara Zagora Region, financed under the National Recovery and Resilience Plan, pursuant to Contract No. from ISUN - BG16FFPR003-4.001-0325-С01, concluded between the Ministry of Regional Development and Public Works, Managing Authority of the “Development of the Regions” Programme 2021-2027 (ПРР), and Maglizh Municipality, for implementation of project proposal BG16FFPR003-4.001-0325 “Energy renovation of a multi-family residential building in the town of Maglizh, 84 Tsar Simeon Veliki Blvd., ID No. 49494.701.703.1, Maglizh Municipality, Stara Zagora Region, which has 61 privately owned residential apartments and one municipally owned residential apartment”. The specific objectives of the investment implementation proposal are: -Improving energy performance by applying the prescribed energy-efficiency measures for the building; -Achieving energy consumption class “A” after applying the energy-saving measures to the residential building; -Achieving more than 30% savings in primary energy for the renovated residential building; -Reducing energy costs in the building as a result of the energy renovation of the residential building; -Reducing greenhouse-gas emissions in the town of MAGLIZH generated by the multi-family residential building; -Ensuring better air quality, improving the residential environment and living conditions of the town’s residents and, in particular, the occupants of the multi-family residential building, in accordance with the sustainable-development criteria; -Improving operational characteristics and bringing the above-mentioned building into compliance with the statutory requirements for construction works under Art. 169 of the ZUT in order to extend the building’s life cycle.
