Construction supervision will be exercised during the execution of construction and installation works under the project: “MAJOR REPAIR OF STREETS IN THE TOWN OF TOPOLOVGRAD AND THE VILLAGE OF ORESHNIK, TOPOLOVGRAD MUNICIPALITY”, divided into lots: LOT No. 1: Provision of construction supervision during the execution of construction and installation works at the site “MAJOR REPAIR OF STREETS IN THE TOWN OF TOPOLOVGRAD, TOPOLOVGRAD MUNICIPALITY” LOT No. 2: Provision of construction supervision during the execution of construction and installation works at the site “MAJOR REPAIR OF CHERNO MORE STREET FROM OT 101 TO OT 62, VILLAGE OF ORESHNIK, TOPOLOVGRAD MUNICIPALITY” LOT No. 3: Provision of construction supervision during the execution of construction and installation works at the site “MAJOR REPAIR OF PENCHO DYANKOV STREET, VILLAGE OF ORESHNIK, FROM OT 66 TO OT 71 IN THE VILLAGE OF ORESHNIK, TOPOLOVGRAD MUNICIPALITY”, financed under the project “MAJOR REPAIR OF STREETS IN THE TOWN OF TOPOLOVGRAD AND THE VILLAGE OF ORESHNIK, TOPOLOVGRAD MUNICIPALITY” pursuant to Administrative Contract No. 26/G.6/02/003977-C01 for the provision of grant financial assistance under the Strategic Plan for the Development of Agriculture and Rural Areas of the Republic of Bulgaria for the period 2023–2027 under Intervention “II.G.6 – Investments in basic services and small-scale infrastructure in rural areas”. The public procurement contract for each lot covers: provision of construction supervision during construction over all types of construction and installation works performed by the contractor at the respective site, in accordance with the statutory powers and obligations of the contractor as the person exercising construction supervision over the construction works, regulated in Art. 166, Art. 168 and Art. 176a of the Spatial Development Act (ZUT). Construction supervision shall be performed within the mandatory scope in accordance with the requirements of the Spatial Development Act (ZUT), the requirements of Ordinance No. 3 of 2003 on drawing up acts and protocols during construction, taking into account the requirements of Ordinance No. RD-02-20-1 of 5 February 2015 on the conditions and procedure for incorporating construction products into construction works in the Republic of Bulgaria of the Ministry of Regional Development and Public Works (MRDPW), State Gazette No. 14 / 20.02.2015, and all statutory and secondary legislation in the field of construction in Bulgaria. The construction supervision service aims to ensure the high-quality execution of construction and installation works, which will be monitored by a qualified consultant. The consultant shall provide “Construction Supervision” under the Spatial Development Act, for which it must hold a Certificate/licence to exercise construction supervision, issued by the Directorate for National Construction Control/the Minister of the Ministry of Regional Development and Public Works (MRDPW) pursuant to Art. 166(2) of the Spatial Development Act (ZUT) for carrying out the activity. SPECIFIC RESPONSIBILITIES: Exercise of construction supervision: the contractor shall be responsible for its activities and obligations as a participant in the investment process, regulated in Art. 166 and Art. 168 of the Spatial Development Act (ZUT), as well as for those arising from Art. 178 of the Spatial Development Act (ZUT), and other applicable provisions of the legislation in force. Construction supervision shall be performed within the mandatory scope in accordance with the requirements of the Spatial Development Act (ZUT), the requirements of Ordinance No. 3 of 31 July 2003 on drawing up acts and protocols during construction, taking into account the requirements of Ordinance No. RD-02-20-1 of 5 February 2015 on the conditions and procedure for incorporating construction products into construction works in the Republic of Bulgaria of the MRDPW, State Gazette No. 14/20.02.2015, and all statutory and secondary legislation in the field of construction in Bulgaria. ASSISTANCE FROM THE CONTRACTING AUTHORITY: The Contracting Authority shall provide the available necessary information and documentation for the provision of the service, information, and assistance during the provision of the individual services. EXPECTED RESULTS FROM PERFORMANCE OF THE CONTRACT: The Contractor shall provide the Contracting Authority with: • A technical passport prepared for the construction works over which it exercised construction supervision during construction, within 30 calendar days after completion of the construction and installation works for the construction and the signing of Statement of Findings form No. 15. • A Final Report prepared for the Contracting Authority, in accordance with the requirements of Art. 168(6) of the Spatial Development Act (ZUT), within 30 calendar days after completion of the construction and installation works for the construction and the signing of Statement of Findings form No. 15. Construction supervision shall be exercised in the volume and scope required by the Spatial Development Act (ZUT) and the relevant secondary legislation, including at least the following activities, divided into two main groups: Main activities: 1) exercising construction supervision over the execution of construction and installation works in accordance with the approved investment design and the requirements of the regulatory acts: 1.1. monitoring and comparison of the works being performed against the scope and content of the investment design; 1.2. monitoring and comparison of the works being performed against the provisions of the applicable legislation in force. 2) inspection of completed construction and installation works and signing of protocols for acceptance of the completed construction and installation works, prepared by the Contractor for the construction and installation works 2.1. attendance at the site and observation and monitoring of the quantities and types of work currently being performed; 2.2. as a result of the performance of sub-activity 2.1, as well as in view of the results of the performance of the works within activity 1 – thorough review of the statements provided by the contractor for the construction and installation works and, if the works performed comply, signing them. 3) ensuring the drawing up of statements and protocols in accordance with the requirements of Ordinance No. 3/2004, before, during and after completion of the construction and installation activities: 3.1. drawing up statements and protocols before commencement of the construction and installation works; 3.2. drawing up statements and protocols during the construction and installation works; 3.3. drawing up statements and protocols after completion of the construction and installation works. 4) environmental protection monitoring during the execution of the construction and installation activities, in accordance with the Environmental Protection Act (EPA), the Waste Management Act and the ordinances thereto: 4.1. prior detailed familiarisation with the provisions of the applicable legislation in force, as well as with the content of the approved design; 4.2. as a result of sub-activity 4.1, as well as in connection with the permanent presence of the contractor’s representatives at the site – establishment and implementation of an environmental protection monitoring system. 5) monitoring the conformity of incorporated materials and products in accordance with the requirements of Ordinance No. RD-02-20-1 of 05.02.2015 on the conditions and procedure for incorporating construction products into construction works in the Republic of Bulgaria. In this regard, it shall carry out control inspections of construction products delivered to the construction site and incorporated into the construction works in order to ensure compliance with the requirement of Art. 169a(1) and Ordinance No. RD-02-20-1 of 05.02.2015 on the conditions and procedure for incorporating construction products into construction works in the Republic of Bulgaria, including carrying out conformity checks of: the technical indicators of the construction products delivered against the data in the declaration of characteristics of the construction products, declaration of performance and test reports submitted by the Contractor for the construction and installation works, against the technical indicators and characteristics specified in the approved investment design, as well as against the detailed bills of quantities and costs for the site: 5.1. prior detailed familiarisation with the tender of the Contractor for the construction and installation works in connection with the performance of the activity; 5.2. as a result of sub-activity 5.1, as well as in connection with the permanent presence of the contractor’s representatives at the site – monitoring the conformity of the incorporated materials and products both with the applicable legislation in force and with the contract with the Contractor for the construction and installation works. 6) prepares a technical passport for the construction works in accordance with the requirements of Ordinance No. 5/28.12.2006. The technical passport shall be delivered to the Contracting Authority on paper in 6 (six) copies, accompanied by an electronic medium in “doc” and “pdf” formats corresponding to the paper copy. The electronic copy shall be provided on a CD or another electronic medium: 7) prepares a final report for the Contracting Authority in accordance with the requirements of the Spatial Development Act (ZUT), after completion of the construction and installation works. The report shall be submitted on paper in 6 (six) copies, accompanied by an electronic medium in “.pdf” and “.doc” formats corresponding to the paper copy. The electronic copy of the report shall be provided on a CD or another electronic medium; 8) monitors the quality of the construction and installation works being performed and, through actions within its competence, prevents disruption of their technological sequence by issuing instructions and orders, which it records in the construction order book: 8.1. monitoring proper compliance with the technological sequence during the execution of the construction and installation works for the construction on the basis of the contract with the contractor for the construction and installation works, as well as good construction practices; 8.2. entering orders in the construction order book in cases where the construction and installation works deviate from the sequence arising from the contract with the contractor for the construction and installation works and/or good construction practices. 9) continuous monitoring of compliance with the schedule for execution of the construction and installation works, as well as monitoring deviations therefrom and promptly reporting to the Contracting Authority any deviations arising during the performance of the works. Requiring measures from the contractor under the contract for construction and installation works to correct deviations, as well as monitoring compliance with those measures and, where necessary, reporting on the latter. 9.1. prior detailed familiarisation with the content of the schedule proposed by the Contractor for the construction and installation works, as well as, where applicable, an updated schedule; 9.2. monitoring compliance with them according to the actual progress of the construction and installation works and, where necessary, informing the Contracting Authority.
