By conducting this procedure, the Contracting Authority aims to conclude a framework agreement with up to three contractors for a period of up to 4 years for the provision of construction supervision for the construction of technical infrastructure elements in Maritsa Municipality, Plovdiv Region. The services covered by the framework agreement include: Provision of construction supervision within the meaning of Art. 168 of the Spatial Development Act (ZUT) for the construction of technical infrastructure elements in Maritsa Municipality, Plovdiv Region. For the activities covered by the contract, the contractor shall comply with the requirements of Art. 168 et seq. of the Spatial Development Act (ZUT): 1. Provision of construction supervision during construction until the acceptance and commissioning of the respective construction project, within the mandatory scope regulated by the Spatial Development Act (ZUT) and the secondary legislation implementing it; 2. Participation in the preparation of all required acts and protocols during construction; 3. Provision of technically qualified natural persons from its team, designated to supervise the construction project for the respective design sections, for the preparation of the acts and protocols regulated by Ordinance No. 3 of 2003 on the preparation of acts and protocols during construction; 4. Exercising control over the completeness and correct preparation of acts and protocols during construction; 5. Opening the construction site and determining the construction line and level for the construction project; 6. Preparing, completing, binding and numbering the pages of the Construction Order Book; 7. Exercising control over the lawful commencement of construction. Suspending construction when it is carried out under the conditions of Art. 224, para. 1 and Art. 225, para. 2 of the Spatial Development Act (ZUT) and in violation of the requirements of Art. 169, paras. 1 and 3 of the Spatial Development Act (ZUT); 8. Exercising control over compliance with occupational health and safety requirements in construction; 9. Exercising control to prevent damage to third parties and property as a result of construction; 10. Notifying the Regional Directorate for National Construction Control of any violation of technical rules and standards within 3 days of identifying the violation; 11. Inspecting and controlling the construction products delivered and incorporated into the construction project that ensure compliance with the basic requirements for construction works set out in Annex I to Regulation (EU) No. 305/2011 of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (OJ, L 88/5 of 4 April 2011), as follows: - mechanical resistance and stability of the construction project/construction structures and the soil foundation under loads during construction and under operational and seismic loads; - safety in the event of fire; - hygiene, health and the environment; - accessibility and safety in use; - protection against noise; - energy economy and heat retention - energy efficiency; - sustainable use of natural resources. 12. Issuing instructions and orders concerning the construction project, entering them in the Construction Order Book and exercising subsequent control over their implementation; 13. Controlling the implementation of orders and instructions entered in the Construction Order Book by other competent authorities and persons; 14. Performing the obligations arising for the person exercising construction supervision from the provisions of Ordinance No. 1 of 16 April 2007 on the investigation of construction accidents; 15. Certifying the as-built documentation when it complies with the requirements of the Spatial Development Act (ZUT) and the completed construction and installation works; 16. Organising the conduct of 72-hour tests under operating conditions as part of the preparation process for commissioning, where such tests are necessary, incl. forming a commission, preparing an order of the Contracting Authority and signing Protocols for conducted 72-hour tests under operating conditions (Annex No. 17 to Ordinance No. 3 of 2003 on the preparation of acts and protocols during construction) /if applicable/; 17. Providing the services of specialists selected from the natural persons specified in the certified list of the team of qualified natural persons through whom the activity is carried out – an integral part of the certificate issued to the Contractor for carrying out the activities under Art. 166, para. 1, item 1 pursuant to Art. 166, para. 2 of the Spatial Development Act (ZUT), and, where necessary, the services of other specialists as well; 18. Controlling the geodetic survey of the site by the Contractor under the Construction Contract (design, construction and provision of designer supervision), preparing documentation for the issuance of the Certificate under Art. 54a of the Cadastre and Property Register Act (ZKIR) and Art. 175 of the Spatial Development Act (ZUT): 19. Exercising control over the Contractor under the Construction Contract regarding the preservation of geodetic markers /axis stones, benchmarks, Working Geodetic Base /RGO/, etc./. If the removal of a geodetic marker is unavoidable, precise referencing shall be carried out. Before removing the marker, the Contractor shall notify the Contracting Authority and restore the destroyed RGO points. 20. Preparing the necessary documentation for the issuance of a Certificate by the Geodesy, Cartography and Cadastre Service that the obligation under Art. 54a, para. 2 of the Cadastre and Property Register Act has been fulfilled for the site, in accordance with the provisions of Ordinance No. RD-02-20-5 of 15 December 2016 on the content, creation and maintenance of the cadastral map and cadastral registers 21. Preparing a Final Report for the construction project pursuant to Art. 168, para. 6 of the Spatial Development Act (ZUT) 22. Preparing a Report on the Implementation of the Construction Waste Management Plan pursuant to Annex No. 6 to the Ordinance of 05.12.2017 on construction waste management and the incorporation of recycled construction materials. 23. Performing the functions of Safety and Health Coordinator. A full description of the subject matter of the procurement is contained in the Technical Specification annexed to the documentation for participation in the procedure.
