BRIEF DESCRIPTION OF THE ACTIVITY WITHIN THE SCOPE OF THE PROCUREMENT: 1. DESIGN; 2. PROVISION OF DESIGNER’S SUPERVISION; 3. PERFORMANCE OF CONSTRUCTION AND INSTALLATION WORKS; The section planned for repair on Nikola Petkov Street has an approximate total length of 1360 linear metres, with the length from reference point 672 – to reference point 1670 being 1200 linear metres, while from reference point 1670 southward toward the town exit along local road 77181.21.336 the length is 160 linear metres. The Contracting Authority sets a maximum permissible period for performance of the procurement of up to 180 calendar days, of which up to 30 calendar days for preparing an investment design at the technical design phase and up to 150 calendar days for performing the construction and installation works. The time limits for performing the activities shall be as proposed by the tenderer. The time limits proposed by tenderers must not exceed the maximum performance periods specified by the Contracting Authority. If any discrepancy with any of the time limits specified by the Contracting Authority is established, the tenderer’s tender will be excluded from further participation in the procedure. 1. The period for preparing an investment design at the technical design phase begins to run from the date of receipt of an assignment letter from the CONTRACTING AUTHORITY to commence the activity of preparing the technical design and continues until the prepared design is handed over by the CONTRACTOR to the CONTRACTING AUTHORITY with a handover and acceptance report. The period for preparing the design does not include the time required to coordinate the prepared design with the competent authorities/persons and utility companies, or any other coordination periods. 2. The period for Performance of the Construction and Installation Works begins to run from the date of signing the Protocol for opening the construction site and determining the construction line and level (Annex 2 to Art. 7, para. 3, item 2 of Ordinance No. 3/31.07.2003 on drawing up acts and protocols during construction) until the signing of the Findings Report establishing the fitness of the construction works for acceptance (Annex No. 15, pursuant to Ordinance No. 3/31.07.2001 on drawing up acts and protocols). 3. Period for exercising designer’s supervision – from the signing of the Protocol for opening the construction site and determining the construction line and level (Annex No. 2 to Art. 7, para. 3, item 2 of Ordinance No. 3/31.07.2003 on drawing up acts and protocols during construction) until the signing of the Findings Report establishing the fitness of the construction works for acceptance (Annex No. 15, pursuant to Ordinance No. 3/31.07.2001. The proposed time limits must be stated as whole numbers. ESTIMATED VALUE OF THE PROCUREMENT: EUR 584 577,06 excluding VAT, of which: -the maximum financial resource for carrying out the rehabilitation and reconstruction of the street is EUR 342 565.56 excluding VAT; -the maximum financial resource for replacement and construction and installation works on the water main is EUR 236 728.14 excluding VAT; -the maximum financial resource for design is EUR 3 579.05 excluding VAT; -the maximum financial resource for exercising designer’s supervision is EUR 1 704.31 excluding VAT. IMPORTANT: Tenderers must prepare their proposals in compliance with the maximum total value of the budget determined by the CONTRACTING AUTHORITY. The stated total estimated value is final for the CONTRACTING AUTHORITY. If a higher price is proposed, the tenderer will be excluded from the procedure pursuant to Art. 107, item 2, letter “a” of the Public Procurement Act – due to non-compliance with this previously announced condition. All payments under the public procurement contract will be made by bank transfer in euros. Payment of the price for performance of the public procurement contract shall be made on the basis of the amount proposed by the Contractor in the price proposal. Source of funding IMPORTANT!!! At the time the procedure is launched, funding has not been secured for the activities that are the subject of the procurement. In this regard and in accordance with Art. 114 of the Public Procurement Act, performance of this public procurement contract will be deemed to have been awarded subject to the suspensive condition that earmarked funding is secured. If such funding is not secured, the contract concluded between the Contracting Authority and the Contractor may not be performed. In this case, either party may terminate the contract unilaterally without notice after three months have elapsed from its conclusion, and the parties shall not owe each other compensation for damages or lost profits”. For this reason, performance begins after confirmation by the Contracting Authority that funding has been secured and submission by the Contractor of the specified performance guarantee. If the performance guarantee is not submitted within the period specified by the Contracting Authority, without objective reasons, the Contracting Authority shall terminate the contract. Either party to the contract may request termination of the contract without notice after a period of three months has elapsed from its conclusion. Where funding has not been secured after a period of 10 months from the conclusion of the contract, the contract shall be deemed terminated.
