The subject of this public procurement is the performance of the functions of consultant/construction supervision and Engineer under the FIDIC Conditions of Contract, Yellow Book, for the project: “Reconstruction and expansion of the internal sewerage network and the accompanying water supply branches in the town of Lyaskovets”. General Conditions”. International Federation of Consulting Engineers (FIDIC), 1st ed., 1999, Bulgarian translation edition: Bulgarian Association of Consulting Architects and Engineers, as well as the relevant Particular Conditions and also the Appendix to Tender under the engineering contract; Technical control of the design under the design and construction (engineering) contract through the preparation of report(s) assessing the conformity of the investment design for the project specified above; Conformity assessment for the Structural part within the meaning of Art. 142, para. 10 of the Spatial Development Act, where applicable; Construction supervision within the meaning of Art. 168 of the Spatial Development Act; “Safety and Health” Coordinator for the construction stage of the project specified at the beginning of these Specifications and in compliance with the conditions of the public procurement specified in Section 1. The performance of this procurement shall comply with that referred to in the preceding sentence. The contract covers the following services (which does not preclude the assignment of additional tasks during the performance of the procurement in accordance with specific needs and particular circumstances): Review, assessment of conformity with the contractual requirements and approval of the Contractor’s Programme; Review, assessment of conformity with the contractual requirements and approval of a revised Programme (one or more) of the Contractor; Monitoring the implementation of the Contractor’s Programme; Review and opinion on the investment design prepared by the Contractor regarding its conformity with the Employer’s Requirements; Preparation of a comprehensive report assessing the conformity of the investment design, as well as identical comprehensive reports during the course of construction, including a conformity assessment for the “Structural” part within the meaning of Art. 142, para. 10 of the Spatial Development Act; Documentary and physical inspection for conformity of the materials and equipment incorporated into the project up to the stage of their approval; Actions to review and approve the Contractor’s insurance policies; Actions to review and approve the Contractor’s guarantees issued in connection with the performance of its contractual obligations; Actions for the issuance of determinations by the Engineer; Actions in the event of unforeseeable physical conditions identified by the Contractor; Actions by the Engineer in the event of the Contractor’s failure to undertake environmental protection measures; Documentary and physical inspection of the construction process; Issuance of interim payment certificates, including the actions preceding them; Actions by the Engineer related to variation procedures; Actions by the Engineer in connection with claims under the contract with the Contractor; Supervision of the preparation of acts and protocols during construction; Organization and conduct of monthly progress meetings, including documentation of their results; Actions by the Engineer related to tests (individual and combined—upon completion); Actions for the issuance of the Taking-Over Certificate for the project; Actions for the issuance of the Performance Certificate; Actions to perform the functions of consultant/construction supervision during the performance of construction; Actions to perform the functions of Safety and Health Coordinator during construction. The services specified above are not exhaustive, and the Engineer is also responsible for all other obligations that are not expressly mentioned but arise from the provisions of this contract and the provisions of the General and Particular Conditions of the construction contracts, where the Employer–Contractor–Engineer relationships are described in detail and cannot be repeated here without repeating the entire text of the conditions of contract, which are therefore attached to this contract. With regard to the powers and competencies of the contractor under this contract in its capacity as Engineer that are not expressly regulated, it shall perform its functions as they arise from the specific conditions of the contract with the Contractor, provided that they do not conflict with the applicable legislation. The contractor under this contract must seek the Employer’s written approval before exercising its functions as the FIDIC Engineer on matters for which the Employer’s authorization is expressly provided for in the clauses of the contract with the engineering Contractor.
