Opportunity description

The performance of the subject matter of the procurement consists of a service for the supply of water of drinking quality, meeting the quality requirements specified in Ordinance No. 9 of 16.03.2001 on the quality of water intended for drinking and household purposes, issued by the Minister of Health, the Minister of Regional Development and Public Works and the Minister of Environment and Water, as well as the conveyance and treatment of wastewater by a water supply and sewerage operator. For a five-year period, the estimated quantity is 6 800 cubic metres. Pursuant to the provision of Art. 193 of the Water Act (WA), public relations associated with the water supply and sewerage services that are the subject of this procedure are governed by the Water Supply and Sewerage Services Regulation Act (WSSSRA) and in compliance with the requirements of the Water Act (WA). Pursuant to Art. 198a, para. 1 of the WA, for the purposes of the management, planning and construction of water supply and sewerage systems and the provision of water supply and sewerage services, the territory of the country is divided into designated territories. The provision of Art. 198o, para. 1 of the WA states that the management, maintenance and operation of water supply and sewerage systems and facilities, as well as the provision of water supply and sewerage services to consumers for payment, are carried out by water supply and sewerage operators in accordance with the WA and the WSSSRA, while para. 2 states that, within the boundaries of one designated territory, only one water supply and sewerage operator may carry out the activities under para. 1. By Decision No. РД-02-14-2234 of 22.12.2009 (published in State Gazette, issue 7 of 26.01.2010) of the Minister of Regional Development and Public Works, the designated operating territories of water supply and sewerage operators and their boundaries were announced. Item 49 of the decision announces the designated operating territory of the water supply and sewerage operator “Водоснабдяване и канализация” ЕООД- Ямбол, covering the territory of Elhovo Municipality. Pursuant to the provision of Art. 5, para. 1 of the WSSSRA, the regulation of water supply and sewerage services is carried out by the Energy and Water Regulatory Commission (EWRC). “Водоснабдяване и канализация” ЕООД- Ямбол is the sole water supply and sewerage operator in the territory of Yambol Province, and therefore the company holds exclusive rights within the meaning of § 2, item 47 of the Supplementary Provisions of the Public Procurement Act (PPA) to carry out this activity in the territory of Yambol Province. The buildings of the Migration Directorate located in the town of Elhovo at 2 Chataldzha Street and 1 Morava Street fall within the operating scope of the water supply and sewerage operator “Водоснабдяване и канализация” ЕООД - гр. Ямбол. The specified operator is included in the list of water supply and sewerage operators with approved prices for the provision of water supply and sewerage services, in connection with the provision of Art. 5, para. 1 of the WSSSRA – position 43, pursuant to EWRC Decision No. Ц-36 of 19.12.2025, effective from 01.01.2026. Pursuant to Art. 65, para. 1 of the Regulations for Implementation of the Public Procurement Act (RIPPA), Art. 64, paras. 2 and 3 of the RIPPA will not be applied and no invitation to participate will be sent, since a contract will be concluded pursuant to Art. 79, para. 1, item 3, letter “c” of the PPA with a company holding exclusive rights to carry out, in the territory of Yambol Province, the activities that are the subject of this procurement – “Водоснабдяване и канализация” ЕООД- Ямбол, with registered office and management address at 20 Dr. Petar Branekov Street, Yambol 8600.
