The supply through the purchase of an apparatus for endoscopic examination is envisaged—video endoscopic equipment for prevention, diagnosis and treatment in the gastroenterology and surgery sector. The procedure provides for the following activities to be carried out: - supply of a brand-new apparatus for endoscopic examination, fully equipped and fitted out in accordance with the activities of the sector in which it will be used. The apparatus shall be supplied in its original packaging, accompanied by all certificates and the CE marking. The apparatus will be used in gastroenterology and therefore shall meet the requirements described in the technical specification and/or have parameters higher than the minimum parameters specified by the Contracting Authority. - installation of the apparatus, diagnostics, configuration and commissioning, as well as training of personnel by sector in operating the apparatus. - full warranty maintenance of the apparatus for a period of no less than 24 (twenty-four months), including possible replacement if a defect arises that cannot be remedied. - servicing. The procedure for opening, examining, evaluating and ranking the tenders shall be carried out in accordance with Art. 104 of the Public Procurement Act and Chapter V, Section VIII of the Regulations for the Implementation of the Public Procurement Act. The subject matter of the public procurement award procedure is: “Supply of medical equipment for the needs of DCC ‘Chaika’ EOOD, divided into lots: Lot No. 1 – ‘Supply of an apparatus for endoscopic examination’; Lot No. 2 – Supply of a tonometer for the needs of DCC ‘Chaika’ EOOD, and Lot No. 3 – Supply of a hematology analyzer for the needs of DCC ‘Chaika’ EOOD. Insofar as the Contracting Authority has applied Art. 21, para. 6 of the Public Procurement Act with regard to Lot No. 2 and Lot No. 3, this procedure will be conducted solely and exclusively for Lot No. 1, namely: ‘Supply of an apparatus for endoscopic examination’. This public procurement contract is divided into lots, with the Contracting Authority having applied the provision of Art. 21, para. 6 of the Public Procurement Act, since for two lots, namely: Lot 2—Supply of a tonometer for the needs of DCC ‘Chaika’ EOOD, and Lot 3—Supply of a hematology analyzer for the needs of DCC ‘Chaika’ EOOD. Pursuant to Art. 21, para. 6 of the Public Procurement Act, the Contracting Authority has the right to award lots under the procedure applicable to the individual estimated value of each of them, provided that the value of the respective lot does not exceed EUR 79 998,77 for supplies and services (see the provision), and the total estimated value of the lots awarded in this manner does not exceed 20 percent of the total estimated value of the procurement contract. In these cases, regardless of the residual value of the procurement contract, it shall be awarded under the procedure applicable to the total estimated value of the entire procurement contract. In view of the foregoing, the estimated value of: The value of Lot No. 2, amounting to €6 806,67 excluding VAT, represents 4,51% of the total value of the procurement contract. The value of Lot No. 3, amounting to €16 340 excluding VAT, represents 10,82% of the total value of the procurement contract. Since the estimated value of Lot No. 2 is less than EUR 25 564,59 excluding VAT, it falls within the scope of Art. 20, para. 4, item 3 of the Public Procurement Act. In view of the foregoing and pursuant to Art. 21, para. 6 of the Public Procurement Act. Lot No. 2 was awarded under Art. 20, para. 4, item 3 of the Public Procurement Act—by direct award. Since the estimated value of Lot No. 3 is less than €25 564,59 excluding VAT, it falls within the scope of Art. 20, para. 4, item 3 of the Public Procurement Act. In view of the foregoing and pursuant to Art. 21, para. 6 of the Public Procurement Act. Lot No. 3 was awarded under Art. 20, para. 4, item 3 of the Public Procurement Act—by direct award.
