1. The subject of this procurement is: “Supply of food products for provisioning the staff canteen of the Customs Agency”. The subject and scope of the public procurement, including each individual lot, comprise the performance of periodic supplies of food and food products with the characteristics and estimated quantities specified in the Technical Specification for the respective lot. Pursuant to Art. 5, para. 1 of the Regulations for the Implementation of the Public Procurement Act (RIPPA) and on the grounds of Art. 116, para. 1, item 1 of the Public Procurement Act (PPA), the Contracting Authority may assign to the contractor an option that includes increasing the maximum value stipulated in the contract by an amount as follows: 1. EUR 20 451,68 excluding VAT for Lot No. 1; 2. EUR 12 782,30 excluding VAT for Lot No. 2; 3. EUR 15 338,76 excluding VAT for Lot No. 3; 4. EUR 11 248,42 excluding VAT for Lot No. 4, and/or extending the term for performance of the contract for the respective lot, but by no more than 6 months. The option may be assigned upon exhaustion of the maximum value of the contract for the respective lot and during its term of validity, with the Contracting Authority being entitled to increase the maximum value stipulated in the contract by an amount up to the value of the envisaged option. On the grounds of Art. 116, para. 1, item 1 of the PPA, the Contracting Authority may, by an additional agreement amending the contract, extend the term for performance of the contract, but by no more than 6 months. On the grounds of Art. 116, para. 1, item 1 of the PPA, both circumstances may be amended by an additional agreement amending the contract: the term of the contract by no more than 6 months and the maximum value of the contract. The option is included within the scope of the contract, and the Contracting Authority assigns its performance and determines its specific scope by means of an additional agreement. The option is a right of the Contracting Authority, but not an obligation. 2. Lots The subject of the public procurement is divided into 7 lots as follows: 1) Lot No. 1 with the subject: “Supply of meat, meat products and fish”; 2) Lot No. 2 with the subject: “Supply of pulses, other food products, packaged, canned and frozen foods”; 3) Lot No. 3 with the subject: “Supply of milk, dairy products and eggs for the needs of the Customs Agency”; 4) Lot No. 4 with the subject: “Supply of fresh fruit and vegetables”; 5) Lot No. 5 with the subject: “Supply of bread and bakery products”; 6) Lot No. 6 with the subject: “Supply of chocolate and sugar confectionery”; 7) Lot No. 7 with the subject: “Supply of coffee capsules for the needs of the Customs Agency”. 3. The estimated value of the procurement, determined in accordance with the provision of Art. 21, paras. 2 and 3 of the PPA as of the date of its opening and in compliance with the rules of Art. 21, para. 1 of the PPA and Art. 27 of the RIPPA, amounts to EUR 519 932,71 excluding VAT. The envisaged option, in accordance with the provision of Art. 21, para. 1 of the PPA, is included in determining the estimated value of the procurement. The estimated values of the individual lots for the term of the contracts are allocated as follows: 3.1. Lot No. 1: “Supply of meat, meat products and fish” – EUR 153 387,56 excluding VAT; 3.1.1. EUR 132 935,89 excluding VAT for periodic supplies of food and food products specified in the Technical Specification for Lot No. 1 and 3.1.2. EUR 20 451,68 excluding VAT for an option to increase the maximum value of the contract and/or extend the term for performance of the contract for the respective lot, but by no more than 6 months; 3.2. Lot No. 2: “Supply of pulses, other food products, packaged, canned and frozen foods” – EUR 97 145,46 excluding VAT: 3.2.1. EUR 84 363,16 excluding VAT for periodic supplies of food and food products specified in the Technical Specification for Lot No. 2 and 3.2.2. EUR 12 782,30 excluding VAT for an option to increase the maximum value of the contract and/or extend the term for performance of the contract for the respective lot, but by no more than 6 months; 3.3. Lot No. 3: “Supply of milk, dairy products and eggs” - EUR 112 484,21 excluding VAT: 3.3.1. EUR 97 145,46 excluding VAT for periodic supplies of food and food products specified in the Technical Specification for Lot No. 3 and 3.3.2. EUR 15338,76 excluding VAT for an option to increase the maximum value of the contract and/or extend the term for performance of the contract for the respective lot, but by no more than 6 months; 3.4. Lot No. 4: “Supply of fresh fruit and vegetables” – EUR 97 145,46 excluding VAT; 3.4.1. EUR 85 897,04 excluding VAT for periodic supplies of food and food products specified in the Technical Specification for Lot No. 4 and 3.4.2. EUR 11 248,42 excluding VAT for an option to increase the maximum value of the contract and/or extend the term for performance of the contract for the respective lot, but by no more than 6 months; 3.5. Lot No. 5: “Supply of bread and bakery products” – EUR 16 361,34 excluding VAT; 3.6. Lot No. 6: “Supply of chocolate and sugar confectionery” – EUR 17 895,22 excluding VAT. 3.7. Lot No. 7: “Supply of coffee capsules for the needs of the Customs Agency” – EUR 25 513,46 excluding VAT. In this public procurement, the Contracting Authority avails itself of the possibility provided by Art. 21, para. 6 of the PPA and will award Lots No. 5, No. 6 and No. 7 under the procedure applicable to the individual estimated value of each of them, which, for Lots Nos. 5, 6 and 7 pursuant to Art. 20, para. 4, item 3 of the PPA, is direct award. The estimated value of each lot does not exceed EUR 79 998,77, and their total estimated value amounts to EUR 59770,02, which does not exceed 20 percent (EUR 103 986,54 excluding VAT) of the total estimated value of the procurement, which amounts to EUR 519 932,71 excluding VAT. Following application of the provision of Art. 21, para. 6 of the PPA and the award of Lots No. 5 through No. 7, the residual value of the open procedure with the subject: “Supply of food products for provisioning the staff canteen of the Customs Agency”, amounts to EUR 460 162,69 excluding VAT. The subject of the lot includes the periodic supply of pulses, other food products, packaged, canned and frozen foods with the characteristics and estimated quantities specified in the Technical Specification for Lot No. 2, and an option that includes increasing the maximum value stipulated in the contract by EUR 12 782,30 excluding VAT and/or extending the term for performance of the contract for the respective lot, but by no more than 6 (six) months. Supplies will be made periodically upon a prior request by the Contracting Authority or its representative. The Contracting Authority is obliged to accept and pay only for the quantities and types that it has requested and that have been delivered under the terms of the contract. Supplies of the products will be made periodically upon a request from the preceding day—daily or on a day specified in the request. Supplies will be made by 07:30 every morning on business days.
