Opportunity description

The subject matter of the public procurement includes the performance of the following activities: subscription maintenance of software products for which a right of use has been acquired and which comprise the hospital information system of УМБАЛСМ „Н. И. Пирогов“ ЕАД (described in detail in Appendix No. 1 Technical Specification), as well as the delivery of additional services and licenses for the following application software products: Гама КОДМАСТЕР, Гама КАЛК, Гама КОНТ, Гама МУЛТИЛАБ, Гама МУЛТИЛАБ-КААВ, Гама СТОР, Гама СТОР-верификация, Гама Mstore/мСтор, Гама mDOCTOR, Гама СЕСПА Линк, Гама Графици, Гама ФУ Линк, Гама GP Master, Гама КОНКУРЕНТ, Гама ДИЕТИ, Гама wBOOKING, Гама wCONCURENT, Гама WEB, Гама ЛИС линк /connection to an external ЛИС/, Гама PACS линк / connection to PACS, Гама Админ, hereinafter referred to as “Software Products”. 1. Subscription maintenance must include updates to the software products and the provision of consultations and services related to their use, as follows: a/ consultations and assistance with the operation of the Software Products used by the Contracting Authority, provided remotely, without an on-site visit, every working day for the duration of the contract from 8:30 to 17:30 (working hours); b/ correction of hidden software errors (BUGS) and, where necessary, database malfunctions resulting from them; c/ provision of amended and supplemented versions (updates) of the system and a description of changes to the existing functionalities of the Software Products used, by publishing them on the CONTRACTOR’S WEB page so that they are accessible to the Contracting Authority. These activities shall be performed at the request of the Contracting Authority in connection with: - inaccuracies (software errors) identified by the Contracting Authority in the operation of the Software Products used; - requirements of laws and secondary legislation, the National Framework Agreement (НРД), and other decisions and instructions of the competent authorities, the implementation of which requires non-substantial changes to already existing functionalities of the Software Products used. Excluded from the scope of the activity under this paragraph are requirements necessitating substantial changes to the existing functionalities of the Software Products, such as, but not limited to, new integrations for the purpose of exchanging data with systems at the local, regional, national, or European level; changes involving expansion of the types of data exchanged; new electronic formats; new coding systems, nomenclatures, and classifications for coding the data exchanged; new standards and protocols for data exchange; introduction of new reporting arrangements; changes to the frequency at which information is exchanged; and others, as well as the development of new functions; d/ provision of amended and supplemented versions (updates) of the system and a description of changes to the existing functionalities of the Software Products used, in connection with improvements in the operation of the Software Products, including additions to the functionality introduced at the CONTRACTOR’S unilateral initiative, by publishing them on the CONTRACTOR’S WEB page so that they are accessible to the Contracting Authority; e/ Establishing the existence of a process for regular backup of the Software Products’ databases maintained by the Contracting Authority (without examining its completeness, structure, and integrity), and providing consultation on its organization and/or improvement, only after submission of a questionnaire completed by the Contracting Authority, once within 10 working days of conclusion of a contract. 2. Additional services: a total of up to 1 500 person-hours (up to 55 per month). 2.1. Additional services at the request of the Contracting Authority within the scope of the Contractor’s activities relating to the maintenance, operation, and updating of the Software Products, consisting of the provision of services related to the development of additional functionalities according to requirements specified by the Contracting Authority or the performance of settings specific to it, correction of database malfunctions resulting from failure to comply with the prescribed technical procedure for operating the Software Products, as well as provision of a maintenance specialist for on-site work. The services shall be provided only at the request (specifying the type of specialist) of the Contracting Authority, shall be performed within the Contractor’s working hours from 8:30 to 17:30, and shall be paid for additionally on the basis of the hourly rate and a protocol signed by both parties. 2.2. Subject to agreement and technical feasibility, the Contractor may accept and perform subscription maintenance activities and additional services under this item outside its working hours, with activities outside working hours paid for on the basis of an hourly rate for work outside working hours. 3. Delivery of up to 110 licenses – the right to use software products at the request of the Contracting Authority, in addition to those specified in item 1. The delivery (at the request of the Contracting Authority) covers all application software products developed by the Contractor as a functional part of the information system of УМБАЛСМ „Н. И. Пирогов“ ЕАД. The total estimated value of the public procurement is 435 733,92 (four hundred thirty-five thousand seven hundred thirty-three euros and ninety-two cents) euros excluding VAT. The stated estimated value is the maximum. A tenderer that has offered a price higher than the estimated value stated in the notice shall be excluded from participation in the procedure. Contract performance period - 24 (twenty-four) months from the signing of the contract. Tender validity period: 6 (six) months from the deadline for receipt of tenders. This public procurement is awarded on the basis of the most economically advantageous tender. The most economically advantageous tender is determined on the basis of the award criterion: "lowest price", pursuant to Art. 70, para. 2, item 1 of the ЗОП. The lowest price shall be the proposed price for performance of the contract excluding VAT. The performance guarantee amounts to 5 % (five percent) of the contract value and shall be released in accordance with the draft contract. When examining the tenders, the appointed committee shall apply the so-called "reversed order", pursuant to Art. 104, para. 2 of the ЗОП, in conjunction with Art. 61 of the ППЗОП. The participants’ Technical and Price Proposals shall be examined before the documents certifying personal status and the selection criteria. Procedure: open. Estimated value: 435,733.92 EUR.
