The subject of this public procurement is: “Public passenger transport on bus routes from the regional transport scheme under the quota of Gulyantsi Municipality”: 1. Bus route “Pleven-Gulyantsi-Gigen-Iskar”, MR No. 1911 with a departure time from Pleven – 07.00 and from the village of Iskar – 05.20. Operates year-round; MR No. 1913 with a departure time from Pleven – 12.00 and from Iskar – 08.30. Operates year-round; MR No. 1914 with a departure time from Pleven – 17.20 and from the village of Gigen – 13.50. Operates year-round; MR No. 1916 with a departure time from Pleven – 16.40 and from the village of Iskar – 07.15. Operates year-round on working days. 2. Bus route “Pleven-Lenkovo-Gulyantsi-Somovit”, MR No. 1931 with a departure time from Pleven – 06.45 and from Somovit – 09.00. Operates year-round. Runs from Monday to Friday; MR No. 1932 with a departure time from Pleven – 07.45 and from Somovit – 09.00. Operates year-round. Runs on Saturday.; MR No. 1933 with a departure time from Pleven – 12.00 and from Somovit – 14.00. Operates year-round. Runs from Monday to Sunday; MR No. 1934 with a departure time from Pleven – 17.30 and from Somovit – 09,00. Operates year-round. Runs on Sunday; MR No. 1935 with a departure time from Pleven – 17.30 and from Somovit – 06.30. Operates year-round. Runs from Monday to Saturday; MR No. 1936 with a departure time from Pleven – 16.00 and from Somovit – 17.30. Operates year-round. Runs from Monday to Sunday, excluding Saturdays. 3. Bus route “Pleven-Gulyantsi-Zagrazhden”, MR No. 1921 with a departure time from Pleven – 09,00 and from Zagrazhden – 06,00. Operates year-round; MR No. 1922 with a departure time from Pleven – 13,00 and from Zagrazhden – 11,00. Operates year-round; MR No. 1923 with a departure time from Pleven – 17,30 and from Zagrazhden – 16,00. Operates year-round. Public passenger transport on the bus route from the approved regional transport scheme under the quota of Gulyantsi Municipality is carried out on interurban bus routes. Performance of the subject of the public procurement must be carried out in full compliance with the routes and route timetables of the interurban bus routes from the regional transport scheme, described in detail by route and time allocation in Section II of the Technical Specification. The Contractor shall provide, at its own expense and risk, passenger transport on the bus routes under the quota of Gulyantsi Municipality. The procurement is financed with funds from the Central Budget. Payment is made through compensation pursuant to the Ordinance on the conditions and procedure for providing funds to compensate and subsidize reduced revenues resulting from the application of fares for public passenger transport by road provided for in statutory instruments for certain categories of passengers (the Ordinance). In return for the transport service performed, provision is made for the Contractor to receive funds to compensate the carrier for reduced revenues resulting from the application of fare concessions for public passenger transport by road provided for in statutory instruments for certain categories of passengers for the transport performed by them, pursuant to the Ordinance adopted by Council of Ministers Decree No. 163/29.06.2015. Funds to compensate journeys with fare concessions are provided up to the amount specified for this purpose in the state budget, in compliance with the priorities for spending budget funds established by the State Budget Act for the respective year. Compensation is paid monthly by bank transfer, after receipt of funds from the Central Budget and submission of the necessary reports by the Contractor, pursuant to the Ordinance adopted by Council of Ministers Decree No. 163/29.06.2015 (amended by Council of Ministers Decree No. 353 of 28.12.2023). The total mileage for the term of the contract, across all bus routes covered by the procurement, is 2 167 840 km. The Contractor undertakes to comply with the requirements concerning drivers’ driving times, interruptions and rest periods when performing transport with vehicles specified in Article 3, point “a” of Regulation (EC) No. 561/2006 of the European Parliament and Ordinance No. N-3 of 07.04.2009. The buses—primary and reserve—that will serve the interurban bus route from the regional transport scheme must be of categories M2 and/or M3, classes II, III and B, with a one-way route length exceeding 30 km. This shall be evidenced by a Certificate of Roadworthiness, Part I, letter A and Part II, and a supplementary inspection card (Appendix No. 7 to Article 38(1) and Appendix No. 9, Supplement 1 to Ordinance No. N-32/16.12.2011 of the Ministry of Transport, Information Technology and Communications). Where light-duty vehicles of category M2 with a technically permissible maximum mass not exceeding 5 t. are proposed, the emissions of the clean light-duty vehicles, pursuant to Ordinance No. N-21 of 19 December 2023, Article 3, must not exceed the limit values. If the proposals are for vehicles of category M2 (Council of Ministers Decree No. 356/29.12.2023), the tenderer is required to propose 1 vehicle that qualifies as a clean vehicle under the Ordinance. The journeys under the transport scheme must be performed using owned or leased means of transport. Tenderers must hold a valid license to carry passengers within the territory of the Republic of Bulgaria, as well as certificates issued for each bus used to perform the transport, or a Community license accompanied by a number of certified copies equal to the number of buses with which they participate in the procedure, and other documents required under the Road Transport Act and its implementing ordinances for the performance of public passenger transport by bus. Continuation from Description section (BT-24-Procedure): The Contractor undertakes to comply with the requirements concerning drivers’ driving times, interruptions and rest periods when performing transport with vehicles specified in Articles 5-9 of Regulation (EC) No. 561/2006 of the European Parliament, Chapter Three, Section I of Ordinance No. N-3 of 07.04.2009 and Chapter Six of the Road Transport Act. Requirements concerning the technical condition of the buses The subject of the procurement, the transport service, must be performed using roadworthy vehicles meeting the requirements of Ordinance No. N-32/16.12.2011 of the Ministry of Transport, Information Technology and Communications on periodic inspections to verify the roadworthiness of road vehicles. Quality requirements: 1. The approved route timetables must be strictly observed. 2. The approved journeys on the respective bus route must be performed exactly. 3. Ensuring passenger comfort: displaying the timetables in a visible place; ticket and pass prices or other information. 4. Compliance with the statutory sanitary and hygiene requirements concerning the cleanliness, heating and ventilation of the passenger compartment, according to the season. 5. Maintaining the environmental and technical qualities of the buses throughout the term of the contract. In the event of a technical or other problem, timely provision of a reserve vehicle to perform the transport service. 6. In the event of failure to meet the quality indicators, the penalties specified in the contract between the parties shall be imposed. Regulatory framework: The public procurement must be performed in accordance with the requirements of the following principal statutory instruments governing public passenger transport by bus: Road Transport Act, Road Traffic Act, Ordinance No. 33/03.11.1999 on public passenger transport within the territory of the Republic of Bulgaria, Ordinance No. 2/15.03.2002 on the conditions and procedure for approving transport schemes and performing public passenger transport by bus /title amended—State Gazette No. 44 of 2011, amended State Gazette No. 51 of 13.06.2023/, Ordinance on the conditions and procedure for providing funds to compensate reduced revenues resulting from the application of fares for public passenger transport by road provided for in statutory instruments for certain categories of passengers, for subsidizing public passenger transport on unprofitable bus routes in urban transport and transport in mountainous and other areas, and for issuing transport documents for performing the transport (the Ordinance), amended by Council of Ministers Decree No. 353 of 28.12.2023, Ordinance No. N-32/16.12.2011 on periodic inspections to verify the roadworthiness of road vehicles, Regulation (EC) No. 561/2006 of the European Parliament, Ordinance No. N-3 of 07.04.2009, Ordinance No. N-21 of 19.12.2023 of the Minister of Transport and Communications. Other performance requirements: 1. The carrier appointed as Contractor for the procurement undertakes to perform it only with the vehicles described in the contract. Replacement of a primary bus (with a reserve bus) is permitted temporarily only where repair work is necessary to remedy unexpectedly occurring faults. 2. Exclusion/removal of a primary bus from the contract is permitted only with the Contracting Authority’s written consent in the event of permanent irreversible damage to the vehicle. 3. At the Contractor’s request, additional vehicles of the same categories M2 or M3, of a class no lower than that agreed, and with the same or better qualities/characteristics (age, environmental category) than those included in the contract may be added to the reserve buses. 4. The buses with which the carrier appointed as Contractor for the procurement will perform the service must meet the requirements of Article 7b of the Road Transport Act, which the tenderer shall declare in the “Technical Proposal” when submitting the tender, and within 5 days of concluding the contract the Contractor undertakes to provide the Contracting Authority with copies of the following documents for each bus: registration certificates, certificates of roadworthiness, “Third-Party Liability” and “Passenger Accident” insurance policies for the vehicles under compulsory vehicle insurance contracts, reports from completed periodic inspections of vehicle roadworthiness, and supplementary inspection cards for passenger transport vehicles.
