1. Exercises continuous construction supervision over the performance of the construction and installation works and the compliance of the construction being carried out with the legal requirements, construction rules and regulations; the technical, technological, sanitary and hygienic, environmental, and fire-safety requirements; the provisions of the investment project and the construction works contract.2. Coordinates the construction process until the issuance of an Occupancy Permit.3. Controls, records and certifies the type of construction and installation works performed at the sub-sites, checks compliance and signs the bills of quantities submitted by the Contractor for the construction and installation works performed, and ensures their delivery to the Contracting Authority;4. Ensures the drawing up of acts and protocols in accordance with the requirements of Ordinance No. 3 of 31.07.2003 on drawing up acts and protocols during construction;5. Ensures compliance with occupational safety conditions in accordance with the Health and Safety at Work Act, Ordinance No. 2 of 22.03.2004 on the minimum health and safety requirements for the performance of construction and installation works and the other regulatory acts governing this matter;6. Exercises environmental protection control during the performance of construction and installation activities in accordance with the Environmental Protection Act and the Waste Management Act and the ordinances thereto;7. Controls the compliance of the materials and products used with the requirements of the Ordinance on the essential requirements and conformity assessment of construction products;8. Ensures that all necessary measures are taken to prevent damage to third parties and property as a result of the construction;9. Checks and signs all interim and final acts and protocols issued during construction and necessary for assessing the quality of the completed works;10. Gives instructions for the accurate and high-quality performance of construction and installation activities and makes decisions on technical matters that do not alter the technical designs;11. Discusses with the design and construction and installation contractors any problems arising in connection with the construction and installation works and informs the Contracting Authority and DNCC of any violation of construction regulations within three days after the violation;12. Before authorizing the performance of the construction works, carries out an inspection and establishes the site’s compliance with the approved design, the construction permit and the protocol for determining the construction line and level;13. Informs the Contracting Authority of all deficiencies and potential problems identified in the preparation of the documentation and at the project site;14. Inspects the construction works and checks whether the performance complies with the specifications and the project technical documentation;15. Monitors the progress of the works by comparing actual progress with the approved program and, if the works are behind schedule, requires the builder to take appropriate measures to improve work progress;16. Controls the implementation of the builder’s work plans;17. Takes all possible action to protect the interests of the Contracting Authority and to manage all adverse events or circumstances that may arise in such a way as to minimize the occurrence of unforeseen costs and interruption or delay in the progress of the works;18. Monitors and controls the quality of the builder’s work and the accuracy of the quality-control test results;19. Requires the Contractor to prepare the as-built documentation and other technical documentation relating to the performance of the construction and installation activities in the cases provided for by law;20. Signs the prepared as-built documentation jointly with the design and construction and installation contractors and submits it to the relevant authorities pursuant to Art. 175 et seq. of the Spatial Development Act;21. Participates in drawing up the findings act under Art.176, para.1 of the Spatial Development Act, after completion of the construction and installation works, jointly with the Contracting Authority and the design and construction and installation contractors, certifying that the site has been completed in accordance with the approved designs, the certified as-built documentation, the construction requirements and the terms of the concluded contract;22. Prepares a technical passport in accordance with the requirements of the Spatial Development Act and Ordinance No. 5/28.12.2006 on the technical passports of construction works. The technical passport shall be submitted in 2 (two) paper originals and in 1 (one) copy on electronic media;23. After completion of the construction and installation works, prepares a final report to the contracting authority. The report shall be submitted in 2 (two) paper originals and in 1 (one) copy on electronic media;24. Performs any other activity necessary for the accurate and high-quality exercise of construction supervision over the site, in accordance with regulatory requirements. The scope of the public procurement includes the exercise of construction supervision in construction pursuant to Art. 168, para. 2 of the Spatial Development Act and the performance of all actions necessary to obtain an Occupancy Permit for the site, as well as the preparation of a technical passport and a final report. The subject matter of the procurement is a service—the exercise of construction supervision and control during the performance of construction and installation works. The person exercising construction supervision must: 1. Exercise continuous construction supervision over the performance of the construction and installation works and the compliance of the construction being carried out with the legal requirements, construction rules and regulations; the technical, technological, sanitary and hygienic, environmental, and fire-safety requirements; the provisions of the investment project and the construction works contract. 2.
