Czechia – Freight insurance and Insurance services relating to transport – Insurance of military equipment transport

Opportunity description

The objective of this procurement procedure is to conclude an insurance contract (hereinafter referred to as the “contract”) with one participant for the purpose of providing cargo insurance for the transport of military equipment within the CV90 project, carried out between the contracting authority and external suppliers. The subject matter of the public contract is insurance relating in particular to the transport of: – separate turrets, – complete military vehicles, – possibly other related components of military equipment. Transport will be carried out by the contracting authority itself or through contractual carriers. The insurance must cover transport generally carried out under FCA terms, while also covering damage arising during the loading and unloading of the transported property, including the use of specialized equipment. Insurance coverage shall commence at the moment the consignment is accepted for transport. Repeated transport operations in various logistics scenarios are anticipated, in particular: – transport between suppliers and the contracting authority, – transport for testing (e.g. Bzenec), – transport for handover to the Armed Forces of the Czech Republic. The number of transport operations, their exact dates and routes may change during performance depending on the development of the project and coordination between the contracting authority and its contractual partners. The contracting authority reserves the right to arrange insurance for individual transport operations according to current needs and is not obliged to use the anticipated scope of performance. Given the nature of the project and the ongoing negotiations between the contracting authority and its partners, it is not possible at the time of awarding the public contract to establish an exact transport schedule or its final scope. The insurance must be arranged so as to cover the variability of transport in terms of timing, scope of performance and type of equipment transported. The contracting authority requires a maximum limit of CZK 200,000,000 per transport operation. The required scope of insurance, i.e. places of insurance, scope and subject matter of insurance, sums insured, deductibles and other insurance requirements, is discussed in greater detail in the Technical Part of the procurement documentation and its annexes. The contracting authority restricts publication of part of the procurement documentation in order to protect sensitive information related to the transport of military equipment. The annexes to the Technical Part of the procurement documentation are not freely available on the contracting authority’s E-ZAK profile. A participant, or an interested party seeking to participate, may request that the contracting authority send the non-public part of the procurement documentation via E-ZAK. The participant shall send the contracting authority a request for the provision of the non-public part of the procurement documentation, including an electronically signed non-disclosure agreement (NDA), via the E-ZAK electronic tool through the “Send message” section. The contracting authority points out that the “Request for clarification of the procurement documentation” function is intended exclusively for submitting questions concerning the procurement conditions and is not intended for sending an NDA or requests for the provision of the non-public part of the procurement documentation. An NDA or requests for the provision of the non-public part of the procurement documentation delivered via the “Request for clarification of the procurement documentation” function will be deemed incorrectly submitted, and the contracting authority will not provide the non-public part of the procurement documentation on their basis. In accordance with Section 36(8) and Section 96(2) of the Act, the contracting authority reserves the provision of the non-public part of the procurement documentation solely on condition that a duly submitted request and an electronically signed NDA are received. The contracting authority will provide these annexes no later than 3 working days after receipt of a duly submitted request. The contracting authority strongly recommends that all interested parties send a request for access to the non-public part of the procurement documentation before submitting a request to participate. The contracting authority points out that the non-public part of the procurement documentation contains information significant for preparing a tender in the second stage of the procurement procedure and for performing the public contract. If a participant does not request access to the non-public part of the procurement documentation, it bears full responsibility for preparing its request to participate and subsequently its tender without knowledge of this information. This fact will not constitute grounds for extending deadlines, amending the procurement conditions or otherwise giving the participant preferential treatment during the procurement procedure. For the avoidance of doubt, the contracting authority states that the public contract in question is not a contract for insurance brokerage services. Given the subject matter of the public contract, the contracting authority does not permit variants of tenders pursuant to Section 102(1) of the Act. A participant that submits a tender containing performance beyond that required in the procurement documentation will be excluded from further participation in the procurement procedure. The participant is obliged to prepare the request to participate / tender in accordance with the procurement documentation, particularly the Technical Part of the procurement documentation. To ensure the comparability of tenders, the contracting authority requires participants to use the terminology and structure set out in the procurement documentation when preparing their tenders (particularly in relation to the definition of insured risks, the scope of insurance coverage and other insurance conditions). The insurance coverage offered must correspond to the required scope stipulated by the contracting authority. If a tender does not meet the procurement conditions, particularly if it contains only partial or otherwise non-compliant performance, the participant may be excluded from the procurement procedure. For participants’ reference, the contracting authority states the anticipated scope of performance in the Technical Part of the procurement documentation (particularly the number of transport operations and indicative values of the property transported).
