Czechia – Occupational clothing, special workwear and accessories – Purchase of personal protective work equipment for employees of the Prague Castle Administration

Opportunity description

The subject matter of this public contract is the supply of personal protective work equipment for employees of the Prague Castle Administration (hereinafter referred to as “SPH”) based on the contracting authority’s current needs for the duration of the contractual relationships in the individual lots. This is a repeated procurement procedure by the contracting authority, as it received no tender in the first procedure and the second procurement procedure had to be cancelled in both lots for the reasons specified in Section 127(2)(d) of the ZZVZ. The contracting authority’s need to provide personal protective work equipment arises in particular from the obligations laid down in Section 104 of Act No. 262/2006 Coll., the Labour Code, as amended, Act No. 309/2006 Coll., regulating further occupational health and safety requirements in employment relationships and ensuring occupational health and safety during activities or the provision of services outside employment relationships (Act on Ensuring Further Conditions for Occupational Health and Safety), as amended, and Government Regulation No. 390/2021 Coll., on the detailed conditions for the provision of personal protective work equipment, washing, cleaning and disinfecting agents, as amended, and, where applicable, other related legislation. The contracting authority is obliged to provide its employees with personal protective work equipment (hereinafter also referred to as “OOPP”) to ensure that they are protected against risks, that their health is not endangered and that they are not hindered in any way when performing their work. Pursuant to Section 35 in conjunction with Section 101 of the ZZVZ, the contracting authority divided the public contract into two lots as follows: Lot 1 – Clothing and accessories Lot 2 – Protective footwear Participants may submit their tenders for any of the listed lots at their discretion, or they may submit one tender for both lots simultaneously. In the tender cover sheet, the participant shall state the lots of the public contract for which it is submitting its tender. Under this procurement procedure, one framework agreement for a period of 48 months will be concluded in each of the listed lots of the public contract, pursuant to Section 131 et seq. of the ZZVZ, with one selected supplier whose tender meets all requirements laid down by law and by the contracting authority in the procurement documents for the relevant lot of the public contract and ranks first in that lot based on the evaluation conducted. The contracting authority anticipates concluding a framework agreement in each lot of the public contract with one supplier, from the effective date of the signed framework agreement for a period of 48 months, or until the specified financial limit for the relevant lot of the public contract is exhausted, whichever occurs first. The total estimated value of this public contract for both lots, including reserved modifications of obligations, amounts to CZK 11,500,000 (in words: eleven million five hundred thousand Czech koruna) excluding VAT. Lot 1 – Clothing and accessories The value of the framework agreement for the entire subject matter of the public contract in Lot 1, i.e. according to the stated definition of the subject matter for Lot 1 in paragraph 1.1 of the procurement documents, amounts to CZK 7,400,000 (in words: seven million four hundred thousand Czech koruna) excluding VAT. The estimated value of the reserved modification of the obligation under the contract (or framework agreement) in Lot 1 of the public contract, in accordance with the rules set out in paragraph 1.6 of the procurement documents, amounts to CZK 300,000 (in words: three hundred thousand Czech koruna) excluding VAT. Therefore, based on the above, the total estimated value of Lot 1 of the public contract and the maximum amount stated in the framework agreement, including the reserved modification of the obligation, amounts to 7,700,000 (in words: seven million seven hundred thousand Czech koruna) excluding VAT. Lot 2 – Protective footwear The value of the framework agreement for the entire subject matter of the public contract in Lot 2, i.e. according to the stated definition of the subject matter for Lot 2 in paragraph 1.1 of the procurement documents, amounts to CZK 3,600,000 (in words: three million six hundred thousand Czech koruna) excluding VAT. The estimated value of the reserved modification of the obligation under the contract (or framework agreement) in Lot 2 of the public contract, in accordance with the rules set out in paragraph 1.6 of the procurement documents, amounts to CZK 200,000 (in words: two hundred thousand Czech koruna) excluding VAT. Therefore, based on the above, the total estimated value of Lot 2 of the public contract and the maximum amount stated in the framework agreement, including the reserved modification of the obligation, amounts to 3,800,000 (in words: three million eight hundred thousand Czech koruna) excluding VAT. Further information on the conditions governing reserved modifications of obligations is provided in the text of the procurement documents. The subject matter of this lot of the public contract will be the supply of clothing and work accessories classified as OOPP, in categories such as jackets, trousers, shorts, leggings, blouses, sweatshirts, vests, T-shirts, dresses, neck warmers, caps, gloves and socks. These are therefore OOPP intended primarily to protect the body, hands and arms. The specific OOPP required in this lot of the public contract are listed in Annex No. 4.1 – Table of the subject matter for Lot 1 and Annex No. 5.1 Technical specification of items for Lot 1. The subject matter of this lot of the public contract will be the supply of protective footwear classified as OOPP. This will primarily include work sandals, low-cut work shoes, ankle-high work boots, year-round low-cut shoes, rubber boots and winter work footwear. These are therefore OOPP intended to protect the feet. The specific OOPP required in this lot of the public contract are listed in Annex No. 4.2 – Table of the subject matter for Lot 2 and Annex No. 5.2 Technical specification of items for Lot 2.
