Opportunity description
The contracting authority is preparing to procure four (4) new BEMU railway vehicles with battery-electric propulsion (hereinafter also referred to as the “Guaranteed Quantity” and the “Vehicles”) for their future use in providing public passenger transport services by rail for the Ústí nad Labem Region within the Švestková dráha BEMU units operating group. For this purpose, the Ústí nad Labem Region has declared its intention to conclude a public service contract with the contracting authority for passenger transport by rail for a period of 15 transport years, with the anticipated commencement date in 2030 (with the possible postponement of the commencement of performance until 2032). The technical, qualitative and safety requirements for the vehicles being procured are based to a significant extent on the requirements established by the Ústí nad Labem Region for their future use in ensuring the region’s transport services. The contracting authority has incorporated these requirements to the appropriate extent into the procurement conditions for this public contract. In connection with the planned procurement of the Vehicles and their future use to provide public services for the Ústí nad Labem Region, the contracting authority intends to seek co-financing for the Vehicles under the second round of the call from the TRANSGov: Modernisation of Public Transport programme (ModF call number: TRANSGov No. 1/2024). The contracting authority therefore (potentially) meets the definition of a contracting authority pursuant to Section 4(2) of the ZZVZ. In view of the intended co-financing of the Vehicles, the contracting authority requires participants in the procurement procedure to familiarise themselves in detail with the conditions and rules of the above-mentioned grant programme, including the conditions of the relevant call, to the extent relevant to the subject matter of this public contract. Participants are obliged to take these conditions into account when preparing their tenders and to comply with them during the subsequent performance of the public contract, if they apply to its performance. The public contract is being awarded through a negotiated procedure with prior publication pursuant to Section 60 of the ZZVZ, because, in view of the conditions of the Tender Procedure, the contracting authority has concluded that its specific need cannot be met without adequate adaptation of solutions already available on the market and, given the complexity of the subject matter of performance, the fact that the technical conditions of the subject matter of performance cannot be sufficiently defined solely by reference to technical standards within the meaning of Section 90(1) and (2) of the ZZVZ, and its direct connection to the conditions of the Tender Procedure, it is necessary to conduct negotiations with participants in the procurement procedure. The purpose of this above-threshold public supply contract, awarded through a negotiated procedure with prior publication pursuant to Section 60 et seq. of the ZZVZ, is to conclude a contract for the supply of the Vehicles together with the provision of servicing services, as well as the possibility of exercising an option beyond the Guaranteed Quantity and to extend the period for providing servicing services, all within the meaning of point 2.9 of this procurement documentation. The procurement procedure will result in the conclusion of a contract for the performance of the public contract with a single supplier. Procedure: neg-w-call. Estimated value: 708,000,000 CZK.
