These tender conditions apply to the implementation of Fyns Almennyttige Boligselskab dept. 12, Mosegården with support from Landsbyggefonden. The tender is conducted as a restricted procedure with prior prequalification pursuant to §§ 58-60 of the Public Procurement Act. Thus, only the companies prequalified by the Contracting Authority will be invited to submit tenders. This invitation to tender covers exclusively the construction work mentioned in these tender conditions. Fyns Almennyttige Boligselskab is a social housing company subject to the legal basis and rules applicable to social housing organisations. The Contracting Authority points out that all project documents appearing in the joint document register are part of the tender documents. The Tenderer is obliged to verify that it has access to the complete project material. The Tenderer is encouraged to read all the tender documents thoroughly, as they contain the information necessary for submitting a tender. The tender documents also consist of questions and answers as well as any correction sheets, which are published on an ongoing basis on the tender portal in anonymised form. The tendered work comprises construction work under a main contract concerning renovation under comprehensive plans for Dept. 12 - Mosegårdsparken, Primulavej 1-73, Lathyrusvej 1-89, Monbergsvej 51-59, 5000 Odense C. The Contracting Authority expects the contract to be concluded in accordance with the timetable. The reason for the duration of the period between the award decision and conclusion of the contract is the application process for operating support for renovation projects awarded by Landsbyggefonden. During the period between the award decision and conclusion of the contract, the Contracting Authority will apply for this. The successful Tenderer is obliged to assist the Contracting Authority with any information if requested by the Contracting Authority. A contract will be concluded with one main contractor. The basis for the works contract forms part of the project material. Only the main contractor must meet the minimum requirements. Grounds for exclusion: The Contracting Authority will exclude applicants covered by: • The mandatory grounds for exclusion in §§ 135(1)-(3) and 136 of the Public Procurement Act. • The voluntary grounds for exclusion in § 137(1), nos. 1-6, of the Public Procurement Act. If an applicant is covered by the mandatory or voluntary grounds for exclusion in §§ 135-136 and § 137(1), nos. 1-6, of the Public Procurement Act, the applicant may demonstrate, by presenting sufficient documentation of its reliability, that it should nevertheless not be excluded, cf. the conditions in § 138 of the Public Procurement Act. If the Contracting Authority intends to exclude an applicant, it will set an appropriate deadline for the presentation of sufficient documentation of the applicant's reliability. Council Regulation (EU) 2022/576 A contract may not be awarded to the following undertakings, cf. Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine: A. Russian nationals or natural or legal persons, entities or bodies established in Russia B. legal persons, entities or bodies over 50% of whose ownership is directly or indirectly held by an entity referred to in point (a) of this paragraph, or C. natural or legal persons, entities or bodies acting on behalf or at the direction of an entity referred to in point (a) or (b) of this paragraph. Likewise, subcontractors or supporting entities covered by the above may not be used if that operator's contribution accounts for more than 10% of the contract value. The Contracting Authority intends to prequalify 5 applicants who will be invited to submit tenders. If more than 5 applicants meet the Contracting Authority's suitability requirements, the Contracting Authority will select the 5 applicants who, overall, have documented the most relevant and comparable experience in relation to the tendered contract. The following will be emphasised in the selection: • The relevance of the references to the present project, including the scope of renovation, type of assignment and complexity. • Experience with main contracts of comparable size and complexity. • Experience with renovation assignments for social housing organisations. • Experience with rehousing, resident contact and work in occupied dwellings. • The applicant's specific role and responsibility in the reference project. • The financial size of the references. References with a contract value of at least DKK 100 million excluding VAT will be given positive weight. References with a contract value of at least DKK 150 million excluding VAT will be given particularly positive weight. In the selection, the Contracting Authority will make an overall assessment of the relevance and comparability of the submitted references.
