Denmark – Cupboards – Voluntary ex ante transparency regarding the procurement of smoke-diving equipment cupboards

FMI has procured new smoke-diving equipment for use on all of the Royal Danish Navy’s ships. The equipment must be stored in specially designed cupboards on board the ships. However, the existing cupboards do not have sufficient capacity to accommodate the new equipment. Pursuant to the International Convention for the Safety of Life at Sea (SOLAS), the Royal Danish Navy’s ships are subject to a requirement that smoke-diving equipment must be installed on board as a prerequisite for sailing, and the ships will be prohibited from sailing if the requirement is not met. New custom-made cupboards for storing the equipment are therefore a prerequisite for maintaining sailing operations and operational deployment. FMI therefore needs to purchase 250 custom-designed smoke-diving equipment cupboards, which must be adapted to the respective locations on board the ships. The procurement is operationally urgent, necessitated by the current security policy situation. Essential security interests require the Danish Defence to place an order with a company that can deliver the necessary smoke-diving equipment cupboards as quickly as possible, as the delivery time is crucial to maintaining the Royal Danish Navy’s operational capacity. Compliance with ordinary procurement procedures risks leading to a prohibition on sailing, which constitutes an unacceptable operational risk, as the Royal Danish Navy is required to maintain operational ships at all times and as this obligation is particularly critical in view of the current security policy situation. On that basis, FMI has entered into negotiations with Cubic-Modulsystem A/S, CVR No. 57817712 ("Cubic-Modulsystem"), concerning the delivery of custom-designed smoke-diving equipment cupboards as quickly as possible. FMI intends to conclude a contract with Cubic-Modulsystem for the procurement of 250 custom-designed smoke-diving equipment cupboards. The contract will not be concluded before the expiry of 10 calendar days calculated from the day following publication of this notice. FMI considers that no reasonable alternative exists and that the direct award is authorized under Section 23, No. 3, of the Danish Public Procurement Act. Procedure: neg-wo-call.
