The drill and saw system is used in various orthopedic and traumatological procedures. The device manufacturer has stated that only accessories manufactured by them may be used with the device. The only possible supplier of the accessories is Conmed Finland Oy. The direct procurement is based on section 40, subsection 2, paragraph 2 of the Act on Public Procurement and Concession Contracts: for technical reasons or reasons related to the protection of exclusive rights, only a specific supplier can carry out the procurement; an additional condition is that no reasonable alternative or substitute solutions exist and that the absence of competition is not the result of an artificial narrowing of the terms of the procurement.
