France – Construction-site supervision services – Operation management assignment for the works in the Concerted Development Zone (ZAC) of the Quartier du Lys in Saint-Louis

Saint-Louis Agglomération (SLA) has decided to undertake the development of the area known as the LYS district through a concerted development zone known as the ZAC du quartier du LYS (Resolution of the Community Council of 28 June 2017). The creation and implementation files and the public facilities programs were approved on 17 December 2025. SLA wishes to entrust the technical, legal, administrative and financial study and implementation of this operation to an operation manager, pursuant to Articles L2422-3 and L2422-4 of the Public Procurement Code. The provisional program for the ZAC du quartier du LYS is described in the implementation file approved on 17 December 2025. The services will be provided under a single public contract awarded pursuant to Articles L2124-1, L2124-3 and R2161-12 to 20 of the Public Procurement Code. It sets out all the conditions for performance of the services. No division into lots is planned, as this is a comprehensive operation management assignment. Division into lots would make performance of the services technically more complex and financially more costly. Furthermore, it is appropriate to have a permanent contractor ensuring the continuity and overall consistency of the services provided. This contract takes effect from the date of its notification to the contractor and continues until the date of final and unconditional acceptance of the services. The overall estimated duration of this contract is 96 months, running from the date of its notification to the contractor (provisionally scheduled for 15/12/2026) until the completion date of all assignments entrusted to the service provider. More specifically, this completion date corresponds to the latest of the following dates: - obtaining discharge for the operation covered by this contract; - where applicable, acceptance by Saint-Louis Agglomération of the contract closure report agreed upon as part of the discharge procedure. The contract duration may be extended by means of a contract modification without this extension giving rise to any compensation whatsoever from SLA. It is specified that, for each assignment, the operation manager may propose in its provisional performance schedule a performance period shorter than the maximum period imposed by the contracting authority. In this case, the period proposed and approved by the project owner shall be contractually binding upon it. In the absence of a proposal for a shorter performance period, the maximum performance period imposed by the contracting authority shall prevail. Unless it is a public body, the contractor must provide evidence of the establishment of a joint and several personal guarantee or a first-demand guarantee covering 100.00% of the advance payment amount. Operation financed from the local authority's own resources. Payment arrangements: in accordance with Articles R.2191-3 to R.2191-63 of the Public Procurement Code. Overall payment period: 30 days. Prices are deemed firm for 1 year from the date of notification of the contract. Thereafter, they will be adjustable annually (see CCAP). An advance payment of 10.00% (or 20.00% for very small enterprises/SMEs) may be granted under the conditions set out in the contract (see CCAP). The contract may be awarded to a single company or a group of companies. No particular form of grouping is required. However, in the event of a joint grouping, the lead member shall be jointly and severally liable. This is a negotiated procedure subject to the provisions of Article R2124-3-5° of the Public Procurement Code. The contracting authority is not in a position to define the technical specifications with sufficient precision, which therefore justifies recourse to such a procedure. The procurement process will take place in several stages: - Stage No. 1: contract notice, procurement rules and selection of candidates invited to submit a tender; - Stage No. 2: sending the invitation to tender to the selected candidates, accompanied by the tender documents, followed by analysis of the initial tenders; - Stage No. 3: negotiation phase(s) concerning the initial tenders and any subsequent tenders from the previously selected candidates; - Stage No. 4: analysis of the final tenders, followed by award of the contract by the Tender Committee.
