France – Construction work for school buildings – Global performance contract for the rehabilitation/new construction project for the LES 3 LUCS school complex - APPLICATION PHASE

Opportunity description

Given the contracting authority's performance objectives for this project, the Company has opted to award a global performance contract in accordance with the provisions of Article L. 2173-3 of the French Public Procurement Code. The choice of such an award method results in the contract not being divided into lots and, de facto, in the use of a single contract. This global public performance contract includes the following services: - Design and Execution of rehabilitation, extension, construction and external development works and temporary buildings where applicable, - Operation - maintenance of the facility, including in particular services enabling performance to be monitored and complied with. It concerns the rehabilitation/new construction project for the Les 3 Lucs school complex, 375 avenue des Poilus 13012 Marseille. This project is described in the programmatic note attached to the Consultation Regulations. The estimated contract amount is: 10,000,000 euros excluding tax. This amount includes: design, works, operation - maintenance. During the competitive dialogue, the contracting authority reserves the option to optimize, clarify or modify the description of the requirements. This contract is divided into several technical phases / parts as follows: - Phase 1: design studies; - Phase 2: execution of the works; - Phase 3: operation - maintenance for 60 months. Any optional tranches will be defined in the initial tender consultation documents. During the consultation, the contracting authority reserves the option to create, modify or remove one or more optional tranches, provided that these developments do not constitute a substantial modification of the conditions of the consultation or the subject matter of the contract. This global performance contract is awarded through a competitive dialogue procedure pursuant to Articles L. 2124-4, R.2161-24 to R.2161-31, L.2171-3, R.2171-2 and R.2171-3 of the French Public Procurement Code. This procedure is justified by the specific and complex nature of the requirement, which necessitates dialogue with the candidates in order to define or develop one or more solutions capable of meeting the contracting authority's requirements. The conduct of the procedure is described in the Consultation Regulations. The arrangements for the dialogue phase are described in the Consultation Regulations. In principle, the contract may be concluded with a single contractor or a consortium of companies. If a joint consortium is formed, the lead member shall be jointly and severally liable with the other members of the consortium. If a joint consortium is formed, where it did not have this form when submitting its application or tender, the contracting authority reserves the right to require the successful consortium to take the form of a joint consortium with a jointly and severally liable lead member. In accordance with the provisions of Article R. 2142-26 of the French Public Procurement Code, the composition of the candidate consortium may not, in principle, be modified between the deadline for receipt of applications and the signing of the contract resulting from this competitive dialogue procedure. Any request to modify the composition of the consortium may be examined only in the cases exhaustively provided for in Article R. 2142-26 of the French Public Procurement Code. In accordance with Article R. 2142-21 of the French Public Procurement Code, a candidate may participate both as an individual candidate and as a member of one or more consortia, or as a member of several consortia, BUT WITHIN THE FOLLOWING LIMITS: The general contractor (works expertise) and the architect (architectural expertise) may apply as part of only one team. For the other services/expertise, the option to submit an application as a member of several consortia applies.
