This contract is established within the framework of a purchasing group formed by the public bodies cited below that operate hospital laundries and named GROUPEMENT ACHAT TEXTILE SUD BRETAGNE INTERHOSPITALIER, “GATSBIH”. It is specified that GCS Achats Santé Bretagne also acts as a central purchasing body in accordance with its constitutive agreement. Its role is specified below. Article 1 Presentation of the central purchasing body By virtue of its statutes, GCS Achats Santé Bretagne carries out the permanent activity of a central purchasing body. This contract falls within this framework, in which the following also participate: GIP SILGOM, to which the GCS has given a mandate to coordinate the purchasing group. In its capacity as coordinator, GIP SILGOM is the contracting authority for this contract within the limits of its powers defined in Article 2.2. The participating establishments, members of the purchasing group listed in Article 2 below. The beneficiary establishments that are not members of the purchasing group but benefit from its availability under the conditions defined in Article 3 below. Article 2 Presentation of the purchasing group This consultation falls within the framework of a purchasing group formed in accordance with the rules defined by Articles L2113-6 and L2113-7 of the French Public Procurement Code and governed by a constitutive agreement signed by its participants. The purchasing group consists of the following establishments CH Centre Bretagne de Pontivy, support establishment of GHT CENTRE BRETAGNE and acting in its name and in the name and on behalf of the following participating establishments: CH Guémené sur Scorff; MAS Guémené sur Scorff; GIP Blanchisserie interhospitalière de Cornouaille GIP Bretagne Santé LogistiqueL GIP SILGOM; Article 2.1 Coordinator GIP SILGOM was designated as coordinator of the purchasing group. A single contract is concluded between the contractor(s) and all participants in the group, represented by the coordinator. During the award phase, the coordinator is responsible for: Determining the method of allocation and the appropriate award procedure to meet the identified need; Preparing the tender documents in accordance with the purchasing policy established by the GCS; Ensuring publication of prior information notices and contract notices; Conducting advertising and competitive tendering procedures; Completing all necessary formalities with candidates and unsuccessful tenderers; Awarding, signing and notifying the contract. During the performance phase, the coordinator is responsible for: Making amendments to the contract, in the form of an addendum or unilateral modification; Renewing the contract; Terminating the contract; Organizing performance monitoring with the contractor(s); Notifying the contractor(s) of any new availability of the contract within the framework of the central purchasing body. Article 2.2 Participants With the exception of the elements expressly listed in Article 2 above, the contract performance phase is the responsibility of each participating or beneficiary establishment. By way of derogation from the applicable CCAG, the participating establishments and beneficiary establishments have the status of purchaser for the performance of the contract, particularly for: The conclusion of subsequent contracts, issuance of purchase orders or service orders; Notification of all decisions relating to contract performance as referred to in the contract documents, excluding those expressly reserved for the Coordinator; Verification, acceptance and receipt of supplies and services or works; Receipt, processing and payment of invoices; Application of contractual penalties. Article 3 Availability through the central purchasing body to beneficiary establishments In its capacity as a central purchasing body, GCS Achats Santé Bretagne may make this public contract available for the benefit of its beneficiary establishments, including those whose membership occurs after the contract is signed. This availability is subject to compliance with the following cumulative conditions: Geographical limit: establishments in the Brittany region Material limit: - Public healthcare, social and medico-social establishments, as well as inter-hospital syndicates pending their transformation; - Private healthcare, social and medico-social establishments of collective interest or nonprofit establishments; - Healthcare establishments under the French Armed Forces Health Service; - Healthcare cooperation groups and social and medico-social cooperation groups; - Public interest groups and economic interest groups whose purpose concerns the healthcare and/or medico-social field; - Federating entities of members belonging to the categories mentioned above. This availability is carried out through a request for availability accepted by GCS Achats Santé Bretagne after consultation with the Coordinator and notified to the contract holder by the Coordinator. From the notification by the Coordinator of the request for availability, the beneficiary establishment becomes, for this contract, a purchaser under the same conditions as the establishments participating in the purchasing group. Availability within the framework of the central purchasing body does not constitute a modification of the Contract. It is a performance measure. It therefore does not give rise to a unilateral modification decision or the conclusion of an addendum, except at the express request of the contract holder. The Contractor is informed of each new availability by letter from the contracting authority (Coordinator), specifying in particular: The effective date of the availability; The lots concerned...
