The purpose of this framework agreement is to implement influencer campaigns for the Provence-Alpes-Côte d'Azur Region. The precise definition of the requirement is set out in the CCTP. This is a framework agreement within the meaning of Articles R. 2162-2 et seq. of the Public Procurement Code, concluded with 3 economic operators (subject to a sufficient number of compliant tenders). In accordance with Articles R2162-3 and R2162-4 of the Public Procurement Code, the contract will be concluded by means of a framework agreement: - partly performed by means of purchase orders in accordance with Articles R2162-13 and 14 of the Public Procurement Code. For this part, the prices are stipulated in the document entitled unit price schedule (BPU). - partly performed by means of the conclusion of subsequent contracts in accordance with Articles R2162-7 and R2162-9 of the Public Procurement Code. This part will be performed at unit prices by purchase order. For this part, the contractors must comply with the maximum prices they indicated in the maximum price schedule. The procedures for issuing purchase orders are set out in the CCAP. For the purchase-order part, the framework agreement is concluded for a maximum annual amount of 500,000 euro(s) excluding tax. The contract is performed for the other part by means of the conclusion of subsequent contracts. For information purposes, for this subsequent-contract part, the maximum amount is estimated by the administration over the entire duration of the framework agreement, including any renewals, at 500,000 euro(s) excluding tax, i.e. 125,000 euro(s) annually. Pursuant to Article L 2113-11 of the CCP, the decision not to divide this framework agreement into lots is justified by the following reasons. The legal grounds are those of Article L2113-11 of the CCP: - the subject matter of the framework agreement does not allow the identification of separate services. Indeed, the purpose of the contract is to implement influencer campaigns for the Provence-Alpes-Côte d'Azur Region across all social networks. These influencer campaigns must be carried out both over the long term in relation to all events and programs implemented by the institution and on the occasion of targeted events organized by the Region. - the buyer is not able to carry out the organization, management and coordination tasks itself. Indeed, the implementation of influencer campaigns by the agency requires a comprehensive approach in order to be coherent as a whole and enable the Region to increase its profile by ensuring visibility for the actions and programs undertaken by it. - awarding separate lots would be liable to restrict competition or risk making the performance of the services technically difficult or financially more costly. Indeed, the contractor plays a key role in the success of the project, both in terms of acting as an intermediary between the Region and the influencers and of the brief to be provided to promote the institution's actions. It is therefore essential for the Region to have a single, dedicated point of contact. The framework agreement is not divided into phases Procedure: open.
