This procedure serves to establish a qualification system pursuant to Section 48 SektVO for the selection of suitable companies for future procurements of planning services for pipeline and facility construction projects, the contract value of each of which exceeds the European threshold. However, the contracting entity also reserves the right to call off services through the qualification system that do not reach the threshold for EU tenders. Applications for admission to the qualification system may be submitted for the following service areas: Planning services for pipeline construction projects / Planning services for facility construction projects. Applications may be submitted for both service areas or for only one of the service areas. Planning services for pipeline construction projects may relate to the new construction or maintenance/rehabilitation of an underground high-pressure gas pipeline pursuant to Section 3 GasHDrLtgV and DVGW AB G 463. The route length, pressure rating and nominal diameter may vary by project. Facility construction projects means gas facilities in accordance with the standards DVGW AB G 265-1 or -3 or DVGW AB G 491 or DVGW AB G 497 within the scope of the High-Pressure Gas Pipeline Ordinance, such as, inter alia, biogas injection facilities (BGEA), gas pressure regulating and metering facilities (GDRMA), or compressor stations. The planning services themselves may include both general planning services and the planning of individual planning phases. Planning phases may include, inter alia, basic evaluation, preliminary, design, approval, implementation and tender planning, site supervision/construction management, specialist site supervision and construction monitoring, as well as the warranty phase. Services for project management and environmental planning in pipeline and facility construction projects may likewise be requested, inter alia, as part of the general planning service. The objective of the qualification system is to prequalify capable and reliable service providers so that procurement procedures for specific procurement needs can be conducted at short notice and efficiently as negotiated procedures without a prior call for competition or as restricted procedures. The contracting entity is responsible for accessing the prequalified companies in the qualification system for the services described and opening corresponding procurement procedures for the award of contracts. However, it remains free to meet individual procurement needs without using the qualification system. The conditions for submitting tenders (e.g. tender conditions with award criteria, contract with service description) will be defined for each tender and made available simultaneously to all prequalified companies via the procurement platform as part of the requests for tenders. For planning services for pipeline and facility construction projects, ONTRAS Gastransport GmbH (ONTRAS) is establishing a qualification system pursuant to Section 48 SektVO. The qualification system is published throughout Europe by means of this notice pursuant to Section 37(1) SektVO. ONTRAS will subsequently award contracts for the services described through a negotiated procedure without a prior call for competition or through a restricted procedure without further notice pursuant to Section 48(9) SektVO and, when selecting the companies to be invited to submit a tender, will limit itself to the prequalified companies in the qualification system. Applicants whose suitability is assessed and established on the basis of the minimum criteria announced in this notice will be maintained by the contracting entity in a corresponding register, separated according to the service areas (planning services for pipeline or facility construction projects). In this regard, the contracting entity reserves the right to introduce a quality status for the qualification system using a traffic-light system. The established prequalification or minimum criteria will be reviewed regularly by the contracting entity—adjustment (amendment or tightening) remains reserved. The contracting entity reserves the right to request some or all documents required to maintain prequalification again and/or in an updated version as needed (e.g. upon expiry of the validity of certifications or for references relating to the reference period). The contracting entity also reserves the right to adjust or tighten the requirements for the minimum or prequalification criteria (particularly regarding references) on a project-specific/project-related basis in individual tenders. Applicants or already prequalified companies will be informed accordingly with the request for tenders in the tenders concerned. The contracting entity will formally and substantively examine and evaluate the applications received, together with the required supporting documents and declarations, on the basis of the minimum criteria specified in this notice and in the application form. Applications that do not meet the procedural conditions and minimum requirements will not be admitted to the qualification system. All prequalified applicants in the relevant service area will be invited to submit a tender. The contracting entity reserves the right to reduce in advance the number of tenderers invited to negotiation meetings to 3 to 5 tenderers on the basis of the initial tenders received and applying the award criteria (successive reduction). Only the tenderers with the highest evaluation scores will be invited to a negotiation meeting. The determination of which award criterion or criteria will form the basis of the evaluation (both price-related and qualitative award criteria may be used) will be communicated to applicants in the procurement documents for each tender. The award criteria will be communicated for each tender with the invitation to submit a tender. Applications for admission to the qualification system may be submitted at any time during the term of the qualification system. The contracting entity intends to launch the first tenders from the qualification system, probably in September/October 2026.
