Germany – Government services – Agency agreement for the delegation of public authority in the area of grant application processing and verification of proof of use

Opportunity description

The tasks incumbent upon the State of Berlin in the area of grants, namely grant application processing (Lot 1) and verification of proof of use (Lot 2), are to be transferred to a legal person under private law on the basis of an agency agreement for a period of 4 years in each case. Pursuant to § 44 Abs. 3 LHO, this legal person is to be granted, by administrative act, the authority to perform these tasks – where necessary – using the forms of action under public law. Lot 1) Grant processing Performance period 01 July 2026 - 30 June 2030: 1. Requesting potential grant recipients to submit grant applications and supplementary application documents 2. formal review and review under grant law of the applications received 3. Issuance of advance-payment, approval and rejection notices 4. Review of notifications of changes as well as applications for amendments and supplementary approvals; issuance of amendment notices Funds management: 1. Payment of grants following verification of the mathematical and factual correctness of the requests for funds submitted by grant recipients and of the payment conditions pursuant to No. 7 AV zu § 44 LHO Bln (the requirements to be observed in this regard can be found in the service description) 2. Monitoring of use and publication pursuant to No. 9 AV zu § 44 LHO Bln 3. Annual report on the grant funds, broken down by grant recipient, containing the following minimum information: outflow of funds, interest and any repayments. Lot 2) Verification of proof of use Performance period 01 October 2026 - 30 September 2030: 1. Verification of proof of use pursuant to No. 11 AV zu § 44 LHO Bln concerning the grants for the funding years, incl. cursory review, in-depth review and preparation of the review memoranda (see service description) Procedure: open.
