1. Land use agreement concerning the use of a municipally owned property for the possible construction and operation of a wind turbine by the contracting party, as well as 2. option agreement concerning the municipality’s possible participation in the operating company yet to be established. The land use agreement grants exclusively rights of use to the municipal property. The construction, operation, and financing of the wind turbine are carried out by the contracting party at its own entrepreneurial risk. The option agreement merely grants the municipality the right, following complete construction and readiness for operation, to acquire a participation of up to 100% in the operating company; there is no obligation to exercise the option or to take over the installation. The municipality does not procure any works, supplies, or services. The agreements serve neither to fulfill a public-law procurement obligation nor to procure municipal utility goods. 1.
