Germany – Storage and warehousing services – Recovery services for personal protective equipment (PPE) and medical devices for the Ulm storage location

The Federal Ministry of Health (BMG) intends to procure recovery services. These services will be awarded by means of a Europe-wide open procedure pursuant to the VgV. Against the backdrop of the rapid spread of the then novel coronavirus SARS-COV-2 (“SARS-COV-2”) in the Federal Republic of Germany and worldwide at the beginning of 2020, the BMG arranged for the procurement of medical consumables and supplies as well as medical devices (hereinafter: items). Since these items can no longer be placed on the market or used, recovery is necessary. In this regard, the BMG (contracting authority - AG) relies on services provided by external disposal companies (contractor - AN). The items consist largely of protective masks and, to a lesser extent, other medical materials (protective goggles and syringes). The items to be recovered are stored on pallets in a warehouse operated by a third party (warehouse service provider) in 89081 Ulm. On an agreed date, the contractor collects the items, in the form of whole pallets, from the storage location using a 40t semi-trailer truck and subsequently recovers them properly in the form of energy recovery or alternative recovery in accordance with the statutory provisions, in particular the Act to Promote Circular Economy and Safeguard the Environmentally Compatible Management of Waste. A pallet of protective masks or other medical materials typically contains homogeneous items of one product type. These items are packed in outer cartons and, in some cases, in additional cartons or plastic packaging. The scope of delivery is packed in outer cartons and, in some cases, in additional cartons or plastic packaging. The contracting authority has no specific figures regarding what proportion of the items is packaged in which manner. The items and the packaging must be sent for proper recovery by the contractor in accordance with the statutory requirements. An estimated proportion of up to 75% of the items must, due to customs requirements, undergo energy recovery without leaving any economically usable residues (customs-compliant recovery). The other portion of the items may be recovered by the contractor using an alternative recovery method in accordance with the statutory provisions, in particular the Act to Promote Circular Economy and Safeguard the Environmentally Compatible Management of Waste. The specific form of recovery (energy or alternative recovery) will be specified by the contracting authority for each recovery order. The contracting authority does not guarantee any specific quantities for each form of recovery. The contracting authority guarantees the contractor a minimum order quantity of “A” (minimum order quantity according to the following table). The maximum order quantity corresponds to the recovery of “B”.
