Opportunity description
Publication of additional work in accordance with Art. 2.163d of the Public Procurement Act 2012 a. Necessity of additional services: During the preliminary (soil and asphalt) investigation, it became apparent that the asphalt pavement is divided into more sections than originally provided for in Kragten's tender. As a result, it proved necessary to take additional asphalt cores so that the requirements of CROW210 could be met for each section. The combined fieldwork (in accordance with the requirements specification, in connection with limiting disruption to the surrounding area and traffic) also required the additional deployment of an archaeologist. These additional activities are essential for the proper execution of the project and safeguard the quality and continuity of the work. b. Not included in the original procurement documents: The need for additional asphalt cores and the additional deployment of an archaeologist were not foreseen and were therefore not included in the original procurement documents and contract. Consequently, the additional activities required could not have been included in the procurement in advance. c. Exclusion of a change of contractor: 1°. For technical and economic reasons, it is not possible to have these additional activities performed by another contractor because they are connected with the fieldwork already performed and the specialist fieldwork by the original contractor, Kragten. Engaging another party would significantly disrupt the coordination, cohesion and progress of the project. 2°. In addition, appointing another contractor would lead to considerable inconvenience (including additional traffic disruption, duplicate planning and coordination problems) and a significant increase in costs (including familiarisation and start-up costs). d. Limitation of price increase: The price increase resulting from the additional work amounts to € 34.361,71. This is less than 50% of the value of the original contract (€ 679.865,70) and therefore remains well within the statutory limit. Procedure: oth-single. Review the original TED notice for the complete requirement, lots, amendments and attachments.
