The Municipality of Hengelo has, pursuant to Article 35(1) and (3) of the Participation Act, established an exclusive right in favor of Menzis N.V. to offer collective health insurance (Municipal Policy) for low-income residents. On the basis of this exclusive right, the concession for the Municipal Policy will be awarded to Menzis for a period of five years, until no later than 31 December 2031. Pursuant to Article 2a.14 of the Public Procurement Act 2012, this concession contract is exempt from the procurement obligation, since the contract is awarded to a party with an exclusive right. Therefore, no statutory publication obligation applies. Nevertheless, this notice is published voluntarily as a transparency measure. Interested parties who disagree with this intended award may bring the matter before the court within twenty calendar days of the publication date. The estimated value of the concession is € 19.195.470,43 for the full five-year term. This value was calculated by BS&F on the basis of the premium, the number of participants and the term of the agreement. The contract concerns offering collective health insurance (Municipal Policy) to residents of the municipality of Hengelo with a low income, limited assets and high healthcare costs, within the framework of special assistance pursuant to Article 35 of the Participation Act.
