Opportunity description

The Municipality of Hellendoorn has concluded an agreement for the delivery, configuration, implementation, transition, management, maintenance, support and further development of an integrated digital infrastructure, platform, connectivity, continuity and workplace solution based on IaaS. The contract includes, among other things, the migration of the existing municipal data center infrastructure, servers, virtual environments and applications to a future-proof IaaS environment, the realization of a modern digital workplace environment, the required platform services, backup, recovery, failover and disaster recovery facilities, security, monitoring, service management and support. The Municipality of Hellendoorn is connected to the Regional Data Network for Municipalities / the regional fiber-optic ring of IT Platform Twente. Existing optical connections, regional facilities, redundancy and performance have been configured within this infrastructure. To ensure the continuity of municipal services, the preservation of existing network performance, the required redundancy and the feasibility of the migration within the available transition periods, it is required that the IaaS environment be directly, redundantly and operationally connected to the RDNG infrastructure. Without a direct RDNG connection, the existing performance, redundancy, regional facilities and transition periods cannot be sufficiently guaranteed. Alternative solutions, such as connections via generic internet connections, VPN configurations, new fiber-optic routes, public cloud platforms or other data center solutions not directly connected to RDNG, do not offer a reasonable alternative or substitute, because they cannot be implemented in a timely manner, with equivalent redundancy, while preserving existing optical capacity, or without unacceptable continuity, performance, security and transition risks. Based on the market exploration and technical analysis carried out, the municipality concludes that, within the necessary technical conditions and time frames, the contract can only be performed by the intended contractor, Visolity BV, using the essential RDNG-connected infrastructure of Previder BV. The municipality therefore awarded the contract using the negotiated procedure without prior call for competition, because competition is absent for technical reasons as referred to in Article 2.32(1)(b)(2) of the Public Procurement Act 2012 and Article 32(2)(b) of Directive 2014/24/EU. The municipality is of the opinion that no reasonable alternative or substitute is available and that the absence of competition is not the result of an artificial restriction of the contract conditions, but arises from objective technical conditions that are necessary for continuity, performance, security, redundancy and the timely transition of the municipal digital infrastructure.
