Purpose of the tender The municipality of Rijssen-Holten, as the contracting authority (hereinafter referred to as: Client), aims, by means of the European Open tender procedure, to conclude a framework agreement with one contractor for the supply and installation of playground equipment for 40 playgrounds in public spaces within the municipal boundaries of Rijssen-Holten, including 12 months* of maintenance and including the supply of related parts for 10 years, but excluding work relating to the subsoil. Citizen participation and sustainability are a crucial part of this contract. *) Within these 12 months, all defects in the work must be remedied immediately at the expense of the intended Contractor, including the associated inspections. Scope The work mainly consists of: - Supplying playground equipment; - Installing playground equipment; - Supplying (separate) parts of/for the playground equipment; - Complete support throughout the entire process from design to realization, in which the neighborhood participates; - A maintenance period of 12 months for the playgrounds. - Including the supply of related parts for 10 years* *) Only the supply of parts necessary for (maintaining) approved playgrounds. Maintenance is carried out by the Client. Participation Within the frameworks (including the play vision and the implementation program) drawn up by the Client, the design for each playground is determined together with local residents and other stakeholders. Participation is included as an award criterion in the tender. Sustainability The Client has ambitions in the area of sustainability and circularity and therefore includes these as award criteria when awarding this contract. Tenderers can distinguish themselves by indicating the extent to which they identify and utilize opportunities relating to these themes within this contract. Outside the scope of the framework agreement Outside the scope of the framework agreement are all further work activities, including, for example, the removal and processing of old playground equipment, maintenance work, and the installation of impact-absorbing surfaces. This work is carried out in-house by the Client. Please note: the surfaces on which the playground equipment will be installed are natural grass or impact-absorbing sand. The supply of natural grass or impact-absorbing sand is also outside the scope of this agreement. Duration of the framework agreement The framework agreement will be concluded for a period of no more than four (4) years. The expected start date of the framework agreement is 29-06-2026, with a fixed term of two (2) years up to and including 28-06-2028, with the option to extend the framework agreement unilaterally (by the contracting authority) twice for one (1) year, up to a maximum of 28-06-2030. If the contracting authority makes use of this extension, it will announce this in writing no later than three (3) months before the expiry date. If this framework agreement is not extended, it will expire by operation of law. However, the Client wishes to complete the contract in the 1st year, 2026-2027, with an overrun into the 2nd year, 2027-2028. Framework budget for the framework agreement without review clause Based on the planned work, it is divided as follows: - Redesign of 40 playgrounds: € 680.000 excluding VAT. - Supply of related parts for 40 playgrounds for 10 years: € 36.000 excluding VAT. =>Total estimated value of the framework agreement (excluding review clause): € 716.000 excluding VAT. Framework budget including review clause (optionally exercisable unilaterally by the contracting authority) If the included review clause is used, the scope will be expanded to: - Redesign of an additional 40 playgrounds (thus 80 playgrounds in total) € 820.000,- - Supply of related parts for 10 years for an additional 40 playgrounds (thus 80 playgrounds in total) € 44.000,- =>Total estimated value of the framework agreement review clause: € 864.000 excluding VAT. The estimated maximum values including the activated review clause are: Redesign of 80 playgrounds: € 1.500.000 excluding VAT. Supply of parts for 10 years for 80 playgrounds: € 80.000 excluding VAT. Total: € 1.580.000 excluding VAT. *** We have no purchase obligation. This framework agreement gives the ultimate contractor the exclusive right to supply (services) to the Client. *** Ceiling amount In this tender, a ceiling amount is specified for the framework agreement with a maximum duration of four (4) years, which has been set at € 1.700.000,- excluding VAT, including the review clause. If, during the maximum term of the framework agreement, the sum of all completed contracts reaches the aforementioned ceiling amount, the framework agreement will end by operation of law.
