A 1. The subject matter of the contract is the supply of 3 (three) brand-new Type C ambulances based on a vehicle manufactured in 2026, with medical equipment, divided into 2 lots. 2. A detailed description of the subject matter of the contract is contained in Appendix No. 3 to this SWZ – “Subject matter of the contract – detailed description”. 3. The subject matter of the contract delivered to the Contracting Authority must meet the following requirements: a) it must be brand-new, complete, operational, not previously used by third parties, and free from physical and legal defects, b) it must be ready for use without any additional purchases or investments, c) it must meet all requirements under Polish law, including in particular those concerning quality and authorization for placing on the market, d) it must comply with the current versions of the PN EN 1789 standard (or equivalent) for the ambulance and PN EN 1865 standard (or equivalent) for medical equipment and meet all conditions specified in the Act of 20 June 1997, Road Traffic Law (consolidated text: Journal of Laws of 2024, item 1251, as amended), e) it must possess the necessary approvals: for completed vehicles (base vehicles together with their bodywork), f) it must comply with the requirements laid down in the applicable provisions of law, including those contained in the Regulation of the Minister of Infrastructure of 31.12.2002 on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text: Journal of Laws of 2024, item 502, as amended), and in the Regulation of the Minister of Health of 03.01.2023 on the designation of the State Emergency Medical Services system and requirements concerning uniforms for members of emergency medical teams (Journal of Laws of 2025, item 1768), g) with regard to medical devices constituting ambulance equipment – it must meet the requirements laid down in the Act of 07.04.2022 on medical devices (Journal of Laws of 2024, item 1620, as amended), h) it must possess a current type-approval certificate issued pursuant to the provisions of the Act of 14 April 2023 on vehicle and vehicle-equipment approval systems (Journal of Laws of 2023, item 919, as amended) and the Regulation of the Minister of Infrastructure of 2 August 2023 on vehicle type approval (Journal of Laws of 2023, item 1651) for each ambulance. 4. The Contractor undertakes to perform the subject matter of the contract in accordance with all requirements of the Contracting Authority specified in this SWZ and in the appendices to the SWZ. NOTE: If the tender documentation (including the technical documentation) indicates trademarks, patents or origin, sources or a particular process that characterizes the products or services provided by a specific contractor, the Contracting Authority permits equivalent solutions compliant with the technical data and parameters contained in the above-mentioned documentation. Equivalent solutions shall mean solutions characterized by parameters no worse than those required and contained in the documentation. Where the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and Article 101(3) of the Pzp Act, the Contracting Authority permits solutions equivalent to those described. A Contractor relying on equivalent solutions is obliged to demonstrate that the solution it offers meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach to the tender a list of equivalent solutions together with their description or standards. 7. The subject matter of the contract must be covered by a warranty. The minimum required warranty periods are specified in Appendix No. 3 to the SWZ. The Contractor is required to indicate the warranty periods in the table according to Appendix No. 3 to the SWZ (Subject matter of the contract-detailed description). If the Contractor does not indicate a warranty period in the tender, the Contracting Authority will assume that the Contractor offers the minimum required warranty period in accordance with Appendix No. 3 to the SWZ. 8. The subject matter of the contract is defined in the Common Procurement Vocabulary (CPV) by the following codes: 34.11.41.21-3 ambulances 33.10.00.00-1 medical devices 9. The draft contract constitutes Appendix No. 5 to the SWZ, is an integral part of this documentation, and the provisions contained therein shall be treated as conditions for the award of the contract. 10. The Contracting Authority does not permit the submission of variant tenders. 11. The Contracting Authority permits the submission of tenders for individual lots within this procedure. 12. Investment purchases are made by the Healthcare Entity using a targeted grant received by the Voivodeship (Agreement No. 234.4.1/2026 concerning the award in 2026 of a targeted grant from the state budget for the performance of a commissioned government-administration task concerning the financing of investment purchases under the Civil Protection and Civil Defence Programme for 2025-2026 (Polish Monitor 2025, item 541, as amended), concluded on 1 July 2026 between the Lublin Voivode and the Lublin Voivodeship. 4. The Contracting Authority will exclude from the procedure Contractors: 1) who have not demonstrated compliance with the conditions for participation in the procedure referred to in Chapter XV(1) of the SWZ; 2) who fail to demonstrate that the grounds specified in Article 108(1)(1-6) of the Pzp Act do not apply to them; 3) to whom the grounds specified in Article 109(1)(1), (4), (5) and (7-10) of the Pzp Act apply; 4) to whom the grounds specified in Article 7(1) of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security (Journal of Laws of 2025, item 514, as amended) apply; 5) to whom the grounds specified in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU L No. 229, p. 1, as amended) apply. details in the SWZ. The Contractor undertakes to perform the subject matter of the contract in accordance with all requirements of the Contracting Authority specified in this SWZ and in the appendices to the SWZ. 5. The subject matter of the contract must be covered by a warranty. The minimum required warranty periods are specified in Appendix No. 3 to the SWZ. The Contractor is required to indicate the warranty periods in the table according to Appendix No. 3 to the SWZ (Subject matter of the contract-detailed description). If the Contractor does not indicate a warranty period in the tender, the Contracting Authority will assume that the Contractor offers the minimum required warranty period in accordance with Appendix No. 3 to the SWZ. The subject matter of the contract is covered by external financing. Investment purchases are made by the Healthcare Entity using a targeted grant received by the Voivodeship (Agreement No. 234.4.1/2026 concerning the award in 2026 of a targeted grant from the state budget for the performance of a commissioned government-administration task concerning the financing of investment purchases under the Civil Protection and Civil Defence Programme for 2025-2026 (Polish Monitor 2025, item 541, as amended), concluded on 1 July 2026 between the Lublin Voivode and the Lublin Voivodeship. With regard to lot No. 1 of the contract: The contract must be performed by the non-extendable deadline of 30 November 2026. This deadline is fixed (a calendar date) and shall not be extended due to an extension of the public procurement procedure. The Contractor shall indicate the deadline for performance of the contract by providing a calendar date in the tender form. Offering a deadline later than 30 November 2026 will result in rejection of the tender as non-compliant with the contract conditions pursuant to Article 226(1)(5) of the Pzp Act. If the Contractor does not indicate a deadline for performance of the contract in the tender, the Contracting Authority assumes that the Contractor offers the maximum required deadline for performance of the contract, i.e. 30 November 2026. JUSTIFICATION FOR THE STRUCTURING OF THE DEADLINE AND THE CONTRACTOR’S LIABILITY (Article 433(1) and Article 452(3) of the Pzp Act): The Contracting Authority indicates that the purchase under lot No. 1 of the contract is financed from a targeted grant from the state budget (Agreement No. 234.4.1/2026 of 1 July 2026 concluded between the Lublin Voivode and the Lublin Voivodeship), which must be used and settled by the non-extendable deadline of 8 January 2027. Failure to meet the delivery deadline — regardless of the reason — will result in the irreversible loss of external financing and the need to cover the entire price from the Contracting Authority’s own funds, as well as the obligation to repay the grant with interest. Within the meaning of Article 433(1) of the Pzp Act, this circumstance justifies structuring the Contractor’s liability for meeting the delivery deadline on the basis of delay, excluding cases of force majeure and circumstances for which the Contracting Authority bears sole responsibility. By submitting a tender, the Contractor declares that it was informed of the above circumstances before submitting it and took them into account when calculating the price and declaring the deadline for performance of the contract. Pursuant to Article 257(1) of the Pzp Act, the Contracting Authority may cancel the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it. The subject matter of the contract is the supply of 1 (one) brand-new Type C ambulance with any type of drive, based on a vehicle manufactured in 2026, with medical equipment. A detailed description of the subject matter of the contract is contained in Appendix No. 3 to this SWZ – “Subject matter of the contract – detailed description”.
