Lease of: 1) Analysers for performing haematological tests, including modules with equipment necessary for performing complete blood counts, staining and digital analysis of smears, sorting and archiving samples, an automatic analyser assessing ESR based on red blood cell sedimentation kinetics, 2) Integrated biochemical and immunochemical modules, a pre-analytical system together with a TLA line and a post-analytical system, together with the successive supply of reagents for the Laboratory Diagnostics Department at the New Oncology Hospital. A detailed description of the subject matter of the contract, including specification concerning the option right, is provided in Annex No. 1.1 point 3 and 1.2 point 15 (general requirements) to the SWZ – Description of the subject matter of the contract (hereinafter referred to as the “OPZ”), and Annex No. 11 to the SWZ – Draft contract. I. The procedure is conducted as an open tender. II. Market consultations were not conducted. III. Information on reserving the possibility of applying for the award of the contract exclusively to Contractors referred to in Art. 94 of the Pzp Act. The Contracting Authority does not provide for any reservations in this regard. IV. The Contracting Authority reserves, pursuant to Art. 139(1) of the Act, the right first to evaluate the tenders and then to examine whether the Contractor whose tender was assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. V. The Contracting Authority does not provide for settlements in foreign currencies. VI. The Contracting Authority reserves, pursuant to Art. 139(1) of the Act, the right first to evaluate the tenders and then to examine whether the Contractor whose tender was assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. VII. The Contracting Authority does not permit the submission of partial tenders in this procedure. The contract in question constitutes an inseparable whole. An artificial division of the contract would be irrational and could jeopardise proper performance of the contract. In accordance with recitals 78 and 79 of the preamble to Classical Directive 2014/24/EU, the contracting authority is free to decide autonomously on the advisability of dividing the contract into lots, guided in this regard by its needs, in particular taking into account the scope of the subject matter of the contract. The complexity of the tender and the high requirements of the Contracting Authority result from serving oncology patients in the region, and proceeding in the form of a consortium will allow faster and more effective implementation of the project and ensure that the Contracting Authority receives the expected solutions. The Contracting Authority requires solutions ensuring full automation of the process, from receipt of biological samples from the pneumatic tube system, through preparation of samples for analysis and analysis of various types of samples, to archiving of the material. Connecting multiple analysers with a TLA line enables easy integration of various devices into a single system, allowing centralised data management, which facilitates interpretation of results and enables better use of equipment and resources, reduces the risk of errors and leads to accurate and reliable results. Faster communication between devices contributes to increased laboratory work efficiency, which shortens the time required to analyse samples and, consequently, the time the doctor and patient wait for the result. VIII. The Contracting Authority does not permit the submission of equivalent tenders. IX. The Contracting Authority provides for contracts referred to in Art. 214(1)(8) of the Act, in the event that the existing contractor for the basic contract is awarded a contract for additional supplies intended either as a partial replacement of products or installations supplied or as an extension of existing supplies or installations, where a change of contractor would oblige the Contracting Authority to acquire materials having different technical characteristics which would result in technical incompatibility or disproportionate technical difficulties in the operation and maintenance of those products or installations. The scope of the above contracts will include the lease of analysers or similar devices and the supply of reagents, with a value not exceeding 50% of the value of the basic contract. X. The Contracting Authority does not provide for an electronic auction. XI. The Contracting Authority states that, before opening the tenders, pursuant to Art. 222(4) of the Pzp Act, it will state the amount it intends to allocate to performance of the contract for the purpose of verifying whether the grounds for cancelling the procedure referred to in Art. 255 point 3 of the Pzp Act have arisen. XII. Pursuant to Art. 257 point 1 of the Pzp, the Contracting Authority provides for the possibility of cancelling this procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. XIII. Information concerning a site visit. Pursuant to Art. 134(2)(9) of the Act of 11 September 2019, Public Procurement Law, the Contracting Authority introduces into the SWZ the possibility of conducting a site visit. Participation in the visit is not mandatory, and failure to participate does not result in rejection of the tender pursuant to Art. 226(1)(18) of the Public Procurement Law. The intention to participate in a site visit must be reported (at least three working days before the planned date of the visit) to the email address: p.pospiech@dcopih.pl on working days from Monday to Friday between 9.00 and 14.00. To arrange a site visit, the Contracting Authority may also be contacted via the procurement platform for the procedure by submitting a request to set a date in the same manner as when submitting questions concerning the procedure. XIV. Employment requirements based on an employment relationship in the circumstances referred to in Art. 95 of the Pzp Act.—The Contracting Authority does not provide for requirements in this regard. XV.
