The subject of the contract is the supply of antineoplastic agents divided into 15 lots. Entity-related evidence concerning proof of the absence of grounds for exclusion from participation in the procedure, submitted at the request of the Contracting Authority by the contractor whose tender received the highest evaluation (within the period specified by the Contracting Authority, not shorter than 10 days): 1) Information from the National Criminal Register within the scope specified in: a) Art. 108(1)(1) and (2) PZP, b) Art. 108(1)(4) PZP, concerning a ruling prohibiting participation in public procurement procedures as a penal measure,– drawn up no earlier than 6 months before its submission. 2) The Contractor’s declaration, within the scope of Art. 108(1)(5) PZP, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on Competition and Consumer Protection (Journal of Laws of 2023, item 1689), as another contractor that submitted a separate tender, or the Contractor’s declaration that it belongs to the same capital group, together with documents or information confirming that the tender was prepared independently of another Contractor belonging to the same capital group. 3) A certificate from the competent head of the tax office confirming that the Contractor is not in arrears with the payment of taxes and fees, within the scope of Art. 109(1)(1) PZP, issued no earlier than 3 months before its submission, and if the Contractor is in arrears with the payment of taxes or fees – together with the certificate, the Contractor is required to submit documents confirming that, before the deadline for submitting tenders, the Contractor paid the taxes or fees due together with interest or fines, or entered into a binding agreement concerning repayment of those amounts due.4) A certificate or other document from the competent local organizational unit of ZUS or the competent regional branch or competent local office of the Agricultural Social Insurance Fund confirming that the Contractor is not in arrears with the payment of social security and health insurance contributions, within the scope of Art. 109(1)(1) PZP, issued no earlier than 3 months before its submission, and if the Contractor is in arrears with the payment of social security or health insurance contributions – together with the certificate or other document, the Contractor is required to submit documents confirming that, before the deadline for submitting tenders, the Contractor paid the social security or health insurance contributions due together with interest or fines, or entered into a binding agreement concerning repayment of those amounts due. 5) An extract or information from the National Court Register or the Central Register and Information on Business Activity, within the scope of Art. 109(1)(4) PZP, drawn up no earlier than 3 months before its submission, if separate provisions require entry in a register or records. 6) If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in Chapter VI Part A paragraph 3 of the SWZ: a) item 1 – it shall submit information from the relevant register, such as a court register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence, or in which the person whom the information or document concerns has their place of residence, within the scope referred to in Chapter VI Part A paragraph 3 item 1 of the SWZ, issued no earlier than 6 months before its submission; b) items 3, 4, 5 – it shall submit a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming respectively that: it has not breached obligations relating to the payment of taxes, fees, or social security or health insurance contributions, its liquidation has not been opened, it has not been declared bankrupt, its assets are not being managed by a liquidator or a court, it has not entered into an arrangement with creditors, its business activity is not suspended, and it is not in another situation of this kind resulting from a similar procedure provided for in the laws of the place where that procedure was initiated; issued no earlier than 3 months before their submission. 7) If, in the country in which the Contractor has its registered office or place of residence, or in which the person whom the document concerns has their place of residence, the documents referred to in item 7) are not issued, or if those documents do not cover all the cases referred to in Art. 108(1)(1), (2) and (4), Art. 109(1)(1) PZP, they shall be replaced, as appropriate, in whole or in part by a document containing, as appropriate, a declaration by the Contractor, identifying the person or persons authorized to represent it, or a declaration by the person whom the document was to concern, made under oath, or, if the country in which the Contractor has its registered office or place of residence, or in which the person whom the document was to concern has their place of residence, has no provisions concerning declarations made under oath, made before a judicial or administrative authority, a notary, or a professional or economic self-government body competent with regard to the contractor’s registered office or place of residence or the place of residence of the person whom the document was to concern. The time limits for issuing the documents and declarations referred to in the preceding sentence shall be governed, as appropriate, by the time limits referred to above in item 6(a)–(b) above. 8) The documents referred to above in Chapter VI Part A paragraph 3 shall be submitted by each of the Contractors jointly applying for the award of the contract. The Contractor may replace the documents indicated in paragraphs 2 and 3 above with a public procurement contractor certificate if the scope of certification confirms compliance with the condition for participation in the procedure and the absence of grounds for exclusion specified by the Contracting Authority.If a certificate is submitted, the Contracting Authority will evaluate it in terms of the scope of certification, validity, and compliance with the requirements specified in the SWZ. To the extent not covered by the certificate, the contractor is required to submit the entity-related evidence required by the Contracting Authority.
