1. The subject of the contract is the supply of disinfectants for the needs of the USK-2 PUM Clinics. The description of the subject of the contract and the estimated quantities of the products are included in the unit price form (Annex 2 to the SWZ, hereinafter also referred to as FCJ). 2. The Contracting Authority requires the offering of: a) medicinal products in accordance with the Act of 6 September 2001 Pharmaceutical Law (Journal of Laws 2001.126.1381, as amended), placed on the market and put into use in the territory of the Republic of Poland in accordance with the applicable regulations for the following tasks: • Task No. 3, items 6,7,8,9,10,17 b) biocidal products authorised for sale pursuant to Article 3(1)(a) of Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products for the following tasks: • Task No. 2, items 1,2,12 • Task No. 3, items 2,3,4,5,16,18 c) cosmetic products authorised for sale pursuant to Article 2(1)(a) of Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products for the following tasks: • Task No. 3, items 1,11,12,14,15 d) medical devices – within the meaning of the Act of 7 April 2022 on medical devices (Journal of Laws 2024.1620, as subsequently amended, hereinafter: “UoWM”), placed on the market and put into use in the territory of the Republic of Poland in accordance with the applicable regulations • in the remaining tasks e) for Task No. 8, the Contracting Authority requires certification for contact with food. 3. The Contracting Authority requires that the shelf life of the offered products be at least 12 months, calculated from the date of delivery to the Contracting Authority’s registered office. Note: for Task No. 2, item 1, the Contracting Authority requires a 24-month shelf life for the offered products. 4. The Contracting Authority does not permit the offering of an equivalent product for the products specified in Task No. 10, where the proprietary name of the product is indicated. For Task No. 10, the Contracting Authority requires the offering of the products indicated in the description of the subject of the contract, which are intended for the cleaning and disinfection of equipment (endoscopes) purchased with a ministerial grant. The equipment is under warranty, and the use of agents other than those recommended by the manufacturer results in the loss of the warranty. After the warranty period has ended, the Contracting Authority will also purchase equivalent fluids. 5. The quantities of the assortment constituting the subject of the contract, specified in the annex to the contract (TASKS NO. 1-10), are estimated values intended for the correct calculation of the tender price, comparison of tenders and selection of the most advantageous tender. The quantity of the assortment ordered during performance of the contract may be decreased or increased within individual assortment items, depending on the Contracting Authority’s actual needs, provided that the value of the tender and, consequently, the Contract of the selected Contractor is not exceeded. The Contracting Authority has the right to order a smaller quantity of products, but no less than 60% of the quantity stated in the unit price form. 6. Pursuant to Article 30(2) of the PZP Act, the Contracting Authority awards the contract in parts, each of which constitutes the subject of a separate procedure. 7. The contract consists of 10 tasks, the detailed description of which is included in Annex 2 FCJ. 8. The Contracting Authority does not permit the submission of variant tenders. 9. The Contracting Authority requires performance of the subject of the contract for a period of 24 months, calculated from the date of conclusion of the contract. Procedure: open.
