Description of the Subject Matter of the Contract: 1. The subject matter of the contract is the successive supply of disinfectants, according to 12 tasks, in accordance with the quantities and requirements contained in Appendix No. 3 to this specification, “Description of the subject matter of the contract”. a) The Contractor may submit tenders for one, several or all tasks. b) tenders that do not contain the full scope of the subject matter of the contract specified in Appendix No. 3 to the specification for individual tasks will be rejected. 2. Additional conditions concerning the subject matter of the contract: a) Any proprietary names of products and materials as well as standards and certificates that may appear in the specification serve to define the desired standard of workmanship and properties as well as the technical requirements envisaged for the subject matter of the contract. In this case, the Contracting Authority permits the use of equivalent solutions. b) If, in the description of the subject matter of the contract, the Contracting Authority has indicated trademarks, patents or origin, sources or a particular process that characterizes the products or services provided by a specific Contractor, solutions equivalent to those described may be offered, provided that they maintain the same minimum technical, quality and functional parameters, etc. c) A Contractor who relies on equivalent solutions is obliged to demonstrate that the solution it offers meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach to the tender a list of equivalent solutions together with their description or standards. 4. PRINCIPLES OF EQUIVALENCE. Any proprietary names of products and materials as well as standards and certificates that may be referenced in the specification serve to define the desired standard of workmanship and properties as well as the technical requirements envisaged for the subject matter of the contract. In this case, the Contracting Authority permits the use of equivalent solutions. The Contracting Authority states that whenever, in the detailed descriptions, the subject matter of the contract is described by indicating a trademark, patent, origin, or technical or quality standards, equivalent solutions are permitted, i.e. solutions having characteristics and technical, functional and quality parameters no worse than those described in the aforementioned elements of the documentation. The Contracting Authority permits the offering of solutions equivalent in terms of technical, functional and quality parameters, provided that they guarantee performance of the subject matter of the contract in accordance with the assumptions set out in this SWZ. The burden of demonstrating the equivalence of the offered solution or equivalent solutions rests with the Contractor. 5. A Contractor who relies on equivalent solutions is obliged to demonstrate that the solution it offers meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach to the tender a list of equivalent solutions together with their description or standards. 6. If the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Pzp Act and cited in the documentation for this procedure, the Contracting Authority permits solutions equivalent to those described. A Contractor who relies on solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies and services it offers meet the requirements specified by the Contracting Authority. 7.
