The subject of the contract is the preparation of a review report on the design documentation and the performance of the function of investor’s supervision inspector over the construction of lowland small water retention facilities (MRN3) in the Świerklaniec Forest District. Small water retention means measures improving the capacity to store water in small natural and artificial reservoirs and to dam it in river and stream channels, canals and ditches for subsequent supply to the environment. The primary objective of carrying out construction investments on the basis of the design documentation will be to improve the moisture content of forest soils, change the unfavorable rapid runoff of surface water from forest areas into slowed runoff, diversify the elements of the forest ecosystem, and have a beneficial effect on biodiversity. Scope of tasks: Task No. 02-31-1.1-01 – construction of an earth reservoir with an area of approx. 0.30ha, a depth of 1.5m, a planned retained water volume of 4500m3, maximum damming up to 1m. The subject of the contract is the preparation of a review report on the design documentation and the performance of the function of investor’s supervision inspector over the construction of lowland small water retention facilities (MRN3) in the Świerklaniec Forest District described in the SWZ. The scope of work includes, among other things: 1) The Contractor will be required to perform the full scope of activities of an investor’s supervision inspector specified by the provisions of the Construction Law Act of 7 July 1994. 2) The Contractor will be required to inspect and provide written opinions on all elements produced during the design process and supplied by the designer carrying out the contract for the preparation of the design documentation. 3) The Contractor will be required to participate actively in meetings and sessions organized by the Contracting Authority during the preparation of the design documentation and during the execution of the construction works, as well as in financial settlements and inspections conducted by entities consulting on and financing the investments and by public administration authorities; 4) As part of supervising the proper preparation of the design documentation, the supervision inspector will be required to prepare a review report within 14 days of the Contracting Authority providing the complete design documentation; 5) At the request of the Contracting Authority, the Contractor will be required to provide written opinions on inquiries concerning the SWZ and to participate in the substantive evaluation of tenders submitted in procedures for the preparation of the design documentation and the execution of the construction works. 6) If, before construction begins or during its execution, defects or inaccuracies are identified in the design documentation, or if it becomes necessary to introduce changes to the documentation in order to use structural solutions or materials other than those originally specified in the design documentation, or to achieve savings and reduce costs, the supervision inspector should submit a written request to the Contracting Authority to introduce changes or corrections to the documentation; 7) The duties of the investor’s supervision inspector during the construction period, particularly at the construction-works stage, include: a) participation in the handover of the construction site to the construction works Contractor, documented by a protocol; b) personal presence at the investment implementation site and ongoing representation of the Contracting Authority at the construction site, supervising compliance of its execution with the provisions of law, the terms of the contract, and the design. The inspector’s working hours should be adapted to the working hours of the works Contractor. In the event of an urgent need, the Contractor is required to appear at the construction site no later than within 48 hours of receiving information by telephone or e-mail; c) organization of supervision in a manner ensuring the timely acceptance of works and technical tests, eliminating the possibility of delays in execution; d) issuing orders and instructions to the construction works Contractor for the proper and reliable performance of the work specified in the contract; e) checking the quality of the works performed and the construction products incorporated, and in particular preventing the use of defective products and products not approved for marketing and use; f) checking and accepting works that will become concealed, participating in tests and technical acceptances, preparing for and participating in the acceptance of completed works in the execution of hydraulic engineering structures, and handing them over for use; g) monitoring compliance with occupational safety rules and the maintenance of order at the construction site; h) supervising the timely execution of the investment, particularly with regard to meeting the deadlines for completing the work and obtaining by the Contractor carrying out the construction all documents necessary for the acceptance of the investment and its commissioning (in accordance with the work schedule); i) checking, verifying the correctness of, and approving all documents required from the Contractor carrying out the construction that are necessary for the acceptance and commissioning of the investment (including certificates, attestations, quality certificates and approvals for use), and subsequently forwarding them to the Contracting Authority; j) suspending works conducted in a manner that threatens safety or is inconsistent with the requirements of the concluded contract and immediately notifying the Contracting Authority of this fact in writing; k) making entries in the construction log; l) approving all materials and equipment intended for use by the construction works Contractor; m) checking the authenticity of documents and certificates, securities, guarantees, and ownership of equipment for which the works Contractor is responsible under the contract; n) informing the Contracting Authority sufficiently in advance of any risks arising during the execution of the works and of the preventive and remedial actions taken; o) preparing necessity protocols for additional, replacement, and supplementary works after their prior approval by the Contracting Authority; p) monitoring the progress of works in technical, financial, organizational, and time terms, and checking their progress against the applicable schedule; q) supervising tests of incorporated materials and products (prefabricated elements) performed by the construction works Contractor; r) ordering the construction works Contractor to perform additional tests of materials or works whose quality is in doubt, subject to the Contracting Authority’s prior approval; s) checking statements of the quantities and values of the works performed, which form the basis for financial settlements between the Contracting Authority and the construction works Contractor, based on the schedule, within 5 days of the works Contractor submitting the relevant documents; t) providing all information necessary for reporting on the implementation of the project throughout its implementation period; u) commencing the acceptance of works that will become concealed or covered within 3 days; v) participation in resolving disputes.
