1. The subject of the contract is the preparation of design documentation together with the provision of author's supervision for the investment project involving the construction of Nowa Wyzwolenia Street, together with obtaining the necessary administrative decisions (including ZRID) or making notifications permitting construction works to be carried out. 2. The contract is divided into two scopes: 1) Scope No. 1 – BASIC, which includes a construction design taking into account the division of the investment into two functional sections and the phasing of implementation, comprising: A. Stage I eastern section: a) Construction of Nowa Wyzwolenia Street in the eastern section in accordance with the attached design guidelines and planning documentation, b) Reconstruction of the intersection with Marynarki Polskiej Street, c) Construction of an engineering structure over the Warzywód II stream, d) Construction of a road drainage system and retention facilities, as well as a stormwater pumping station with a balancing tank, e) Removal of part of the Obrońców Westerplatte Family Allotment Gardens, f) Performance of soil tests for the presence of contamination, g) Construction of street lighting and possible dismantling of any existing lighting, h) Removal of any conflicts with existing underground and above-ground utilities or their protection, i) Resolution of other issues and problems that arise during the design process, including those resulting from the technical conditions of network operators and required approvals, j) Preparation and approval of a greenery design and greenery protection design identifying valuable specimens of trees and shrubs, together with recommendations and guidelines aimed at preserving as much greenery as possible during the investment process, k) Preparation and approval with the Gdańsk Greenery Authority of a greenery inventory with tree-stand management, l) If trees or shrubs are felled, a replacement planting design must be prepared and agreed upon—the type of plantings and their location—with the Road Authority, m) Preparation of applications and obtaining decisions—permission to carry out construction works and permission to conduct archaeological research—from the Pomeranian Voivodeship Conservator of Monuments (if required), n) Preparation of applications and obtaining a decision—a water-law permit, o) Preparation of the necessary materials and obtaining the necessary administrative decisions, including construction permits (ZRID), or making notifications permitting construction works to be carried out. p) Identification of the entities whose opinions will be necessary to obtain the ZRID decision. B. Option and conditions for its exercise. 3.1. Pursuant to Art. 441 of the Act of 11 September 2019—Public Procurement Law, the Contracting Authority provides for the possibility of exercising the option under the following conditions. 3.2 Type and value of the option. 1) The option covers the performance of Scope No. 2 of the contract. 2) Value of the option—as per the Contractor's tender. 3.3. Circumstances for exercising the option. 1) Performance of Scope No. 2 of the contract (OPTION) will take place only if the Contracting Authority issues an instruction to commence Scope No. 2. The Contracting Authority is entitled, but not obliged, to issue an instruction to commence the performance of Scope No. 2. The Contractor will commence performance of the optional scope if and after the Contracting Authority issues an instruction to commence the performance of Scope No. 2. The Contracting Authority may issue an instruction to commence performance of the optional scope within 21 days from the date of acceptance of the first acceptance item. 2) Performance of Scope No. 2 will take place in accordance with the conditions specified in the SWZ together with the appendices, including the Draft Contractual Provisions constituting Appendix No. 9 to the SWZ. 4. The detailed scope of the contract and the performance conditions have been specified in the Description of the Subject Matter of the Contract, constituting Appendix No. 8 to the SWZ. The remaining conditions for performance of the contract have been specified in the Draft Provisions of the Public Procurement Contract, constituting Appendix No. 9 to the SWZ. 1.
