The subject of the contract is the preparation of design and cost-estimate documentation for the task: Reconstruction of Pavilion No. XVII for use as an inpatient psychiatric ward constituting an organizational unit of the Mental Health Center. The task is co-financed from the Medical Fund under a specific-purpose grant awarded by the State Treasury – Minister of Health for implementation of the investment program entitled “Reconstruction of pavilions: No. XVIII into a forensic psychiatry ward with enhanced security, No. XIV into a psychiatric ward for children and adolescents, and No. XVII into a psychiatric ward within the Mental Health Center at the St. Kryzan Hospital for the Nervously and Mentally Ill in Starogard Gdański”. Agreement No. DOI/FM/SIS/PSYCH/2026/402/43. A detailed definition of the subject of the contract is contained in the “Description of the subject of the contract” (OPZ), constituting Appendix No. 1 to the SWZ. The Contractor is obliged to provide author’s supervision during the performance of construction works carried out on the basis of the design documentation prepared, but for no longer than a period of 3 years from the date of acceptance of the design documentation. In the description of the subject of the contract, the Contracting Authority has taken into account accessibility requirements for persons with disabilities and design intended for all users, in accordance with Article 100(1) of the Pzp Act. Contractors may jointly apply for the award of the contract within the meaning of Article 58(1) of the Act. Contractors jointly applying for the award of a public contract (e.g. consortium members, entrepreneurs conducting business in the form of a civil-law partnership) are required to appoint an Attorney-in-Fact to represent them in the procedure or to represent them in the procedure and conclude the agreement. Pursuant to Article 139(1) of the Pzp Act, the Contracting Authority provides for a reverse procedure, i.e. it may first examine and evaluate the tenders and then carry out the entity qualification of the contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. The Contracting Authority informs that it provides for the possibility of the contractor conducting a site visit, subject to prior arrangement of the date. The date of the site visit must be agreed with the Administrative and Economic Department (e-mail: k.narloch@kocborowo.pl,a.panitz@kocborowo.pl; tel. 58 56 20 600 ext. 2266). The site visit may be conducted from Monday to Friday (excluding public holidays) between 8:00 and 13:30. The site visit will take place under the supervision of a representative of the Contracting Authority. The Contracting Authority will not provide Contractors with explanations during the site visit. Any inquiries related to issues arising from the site visit may be addressed to the Contracting Authority only in accordance with the provisions of the SWZ. Participation in the site visit is not mandatory. The GDPR information clause is contained in the SWZ. The necessary hardware and application requirements enabling work on platformazakupowa.pl, i.e.: a. permanent access to the Internet with a guaranteed bandwidth of no less than 2 Mbit/s, b. a PC or MAC computer with the following configuration: memory min. 2 GB RAM, Intel IV 2 GHZ processor or a newer version thereof, one of the operating systems – MS Windows 7, Mac Os x 10 4, Linux, or newer versions thereof, c. an installed web browser supporting Javascript, e.g.: EDGE, Chrome,FireFox, in the latest available version, with Javascript support enabled, accepting “cookies” files or allowing use of the browser’s local storage, d. communication with platformazakupowa.pl is encrypted using the TLS 1.3 protocol e. The time of data receipt by the purchasing platform is synchronized with the official time applicable in Poland, determined by the time servers of the Central Office of Measures using the NTP protocol. Requirements concerning employment by the contractor or subcontractor under an employment contract – after analyzing the subject of the contract in the context of Article 95 of the Public Procurement Law, the Contracting Authority refrains from formulating conditions in the above scope. 17.27. The authorization of the persons signing the tender to represent the contractor in the procedure must follow directly from the documents attached to the tender. This means that, in order to confirm that the person acting on behalf of the contractor is authorized to represent it, the Contracting Authority requires the contractor to submit an extract or information from the National Court Register, the Central Register and Information on Economic Activity, or another appropriate register. 17.28. The Contractor is not obliged to submit the documents referred to in point 17.27 if the contracting authority can obtain them using free and publicly available databases, provided that the contractor has indicated the data enabling access to those documents. 17.29. If a person acts on behalf of the contractor whose authorization to represent it does not follow from the documents referred to in point 17.27, the contracting authority requires the contractor to provide a power of attorney or another document confirming authorization to represent the contractor. 17.30. The provisions of points 17.27–17.29 shall apply accordingly to a person acting on behalf of contractors jointly applying for the award of a public contract. 17.31. The provisions of 17.27–17.29 shall apply accordingly to a person acting on behalf of an entity making resources available under the rules specified in Article 118 of the Pzp Act. The Contracting Authority provides for the possibility of making material amendments to the provisions of the concluded agreement – the relevant provisions are contained in the draft agreement – Appendix No. 2 to the SWZ. 12.7. Before selecting the most advantageous tender, the Contracting Authority will call upon the Contractor whose tender received the highest evaluation to submit, within a specified period of no less than 10 days, the following entity-related means of evidence valid as of the date of submission (the request will be sent to the contractor via the purchasing platform) platformazakupowa.pl: 12.7.1. an extract or information from the National Court Register or from the Central Register and Information on Economic Activity, within the scope of Article 109(1)(4) of the Act, drawn up no earlier than 3 months before its submission, if separate regulations require entry in a register or records; 12.7.2. information from the National Criminal Register within the scope specified in Article 108(1)(1), (2), and (4) of the Act, drawn up no earlier than 6 months before its submission; 12.7.3. a declaration by the Contractor, within the scope of Article 108(1)(5) of the Act, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on Competition and Consumer Protection, as another contractor that submitted a separate tender, partial tender, or request to participate in the procedure, or a declaration of belonging to the same capital group together with documents or information confirming that the tender, partial tender, or request to participate in the procedure was prepared independently of another contractor belonging to the same capital group. The declaration template is provided in Appendix No. 9 to the SWZ; 12.7.4. the Contractor’s declaration that the information contained in the declaration referred to in Article 125(1) of the Act remains valid, within the scope relating to the grounds for exclusion indicated in Article 108(1)(3)–(6) of the Act, i.e.: a) Article 108(1)(3) of the Act, b) Article 108(1)(4) of the Act, concerning the imposition of a prohibition on applying for a public contract as a preventive measure, c) Article 108(1)(5) of the Act, concerning the conclusion of an agreement with other contractors aimed at distorting competition, d) Article 108(1)(6) of the Act – in accordance with the template constituting Appendix No. 10 to the SWZ. 12.7.5. A list of services performed during the last 5 years, or, if the period of conducting business is shorter, during that period, specifying the subject matter, dates of performance, and entities for which the services were performed, together with evidence specifying whether those services were duly performed, where the evidence referred to consists of references or other documents prepared by the entity for which the services were performed, and if, for reasons beyond its control, the contractor is unable to obtain those documents – a declaration by the contractor. The list template is contained in Appendix No. 7 to the SWZ. 12.7.6. a list of persons assigned by the contractor to perform the public contract, together with information on their qualifications and experience necessary to perform the public contract, as well as the scope of the activities performed by them and information on the basis for having those persons at its disposal – the list template is contained in Appendix No. 8 to the SWZ. 12.8. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in: 12.8.1. point 12.7.1 of the SWZ, it shall submit a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or court, it has not entered into an arrangement with creditors, its business activity is not suspended, and it is not in any other situation of this kind resulting from a similar procedure provided for in the laws of the place where that procedure was initiated; 12.8.2. point 12.7.2 of the SWZ, it shall submit information from the relevant register, such as a court register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence, or in which the person to whom the information or document relates has their place of residence, within the scope specified in Article 108(1), (2), and (4) of the Act; 12.9. The document referred to in point 12.8.1 of the SWZ should be issued no earlier than 3 months before its submission. The document referred to in point 12.8.2 of the SWZ should be issued no earlier than 6 months before its submission. 12.10. If, in the country in which the contractor has its registered office or place of residence, or in which the person to whom the document relates has their place of residence, the documents referred to in point 12.8 are not issued, or if those documents do not refer to all the cases referred to in Article 108(1)(1), (2), and (4) of the Act, they shall be replaced, as appropriate, in whole or in part by a document containing, as appropriate, a declaration by the contractor identifying the person or persons authorized to represent it, or a declaration by the person to whom the document was to relate, made under oath, or, if the country in which the contractor has its registered office or place of residence, or in which the person to whom the document was to relate has their place of residence, has no provisions on declarations made under oath, made before a judicial or administrative authority, a notary, or a professional or economic self-government body competent with regard to the contractor’s registered office or place of residence or the place of residence of the person to whom the document was to relate.
