Opportunity description

I. 1. The subject of the contract is the updating of the design documentation for the thermal modernization of the building of Primary School No. 46 at ul. Kombatantów 2 in Bydgoszcz, within the scope and under the conditions specified in the Specification of Contract Terms, including Annex No. 8 entitled “Description of the subject of the contract”. 2. For interested Contractors, the Contracting Authority provides the opportunity to participate in a meeting to view the site of the planned investment: on 16.09.2026 at 14:00. The meeting place is at the entrance to the building of Primary School No. 46. Participation in the meeting is not mandatory. The Contracting Authority does not provide for an inspection of the documents necessary for the performance of the contract (Article 131(2) uPzp). 3. The Contracting Authority does not provide for the award of contracts referred to in Article 214(1)(7) uPzp. 4. The Contracting Authority requires a performance bond amounting to 5% of the total price stated in the Contractor’s tender. II. 1. CERTIFICATES. The means of evidence concerning the entity specified in Chapter X of the SWZ may be replaced by a valid public procurement contractor certificate referred to in Article 124(2) uPzp, solely to the extent to which the certificate confirms the absence of grounds for exclusion or compliance with the conditions for participation in the procedure (if conditions have been specified in the procedure), within the scope corresponding to the requirements specified in the SWZ. The certificate does not replace means of evidence concerning the entity relating to grounds for exclusion not covered by certification, in particular Article 108(1)(6) uPzp, Article 109(1)(6) uPzp, Article 7(1) of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security, as well as circumstances arising during this procedure. 2. The certificate replaces means of evidence concerning the entity solely within the scope covered by valid certification and indicated by the contractor in the declaration referred to in Article 125(1) uPzp. If the certificate covers only some of the grounds for exclusion or part of a condition (if conditions have been specified in the procedure) for participation in the procedure, or confirms compliance with a condition at a level lower than that required in the SWZ, the contractor shall submit means of evidence concerning the entity for the remaining scope. 3. Within the scope resulting from a valid certificate, the contracting authority shall not require other means of evidence concerning the entity from the contractor, subject to Article 124(4) uPzp and Article 31(6) of the Act on the Certification of Public Procurement Contractors. 4. Pursuant to Article 126(1) uPzp, before selecting the most advantageous tender, the contracting authority shall request the contractor whose tender received the highest evaluation to submit, within a specified period of no less than 10 days from the date of the request, the means of evidence concerning the entity specified in Chapter X, valid as at the date of submission, to the extent to which they have not been replaced by a valid public procurement contractor certificate, taking into account the following provisions: 1) If the preliminary declaration referred to in Article 125(1) uPzp indicates that the contractor will use a certificate, and the contractor has provided the data required under Article 273(2) uPzp, the contracting authority shall independently verify the certificate in the certification database and shall not request the contractor to submit means of evidence concerning the entity to the extent to which the circumstances required by the contracting authority are evidenced by that certificate, in accordance with Article 274(4) uPzp, 2) If the certificate does not cover all circumstances required by the contracting authority, the contracting authority shall request the contractor to submit means of evidence concerning the entity solely to the extent not covered by certification 3) If the data indicated by the contractor do not allow the certificate to be found or verified in the certification database, the contracting authority may request the contractor to submit, supplement, correct or clarify those data in accordance with the rules set out in Article 128(1) or (4) uPzp. If, despite the request, the contracting authority is unable to verify the certificate, the certificate shall not be taken into account to the extent that it cannot be verified. 4) If the data necessary to assess the circumstances confirmed by the certificate have not been disclosed in the certificate or in the certification database due to their legally protected nature, the contracting authority may require the contractor to make those data available or consent to their disclosure to the contracting authority by the certification body, pursuant to Article 31(6) of the Act on the Certification of Public Procurement Contractors. 5) If the contracting authority obtains information indicating that the contractor misled the certification body, which could have had a material impact on the granting of public procurement contractor certification, or that the contractor ceased to meet the conditions for granting that certification (if conditions have been specified in the procedure), the contracting authority, pursuant to Article 128a(1) uPzp, shall request the contractor to submit explanations within a specified period of no less than 5 days from the date of the request. If the contracting authority considers the contractor’s explanations insufficient, it shall apply Article 128a(2) uPzp. 6) If the validity of public procurement contractor certification is suspended during the procedure, the contracting authority, pursuant to Article 128a(3) uPzp, shall request the contractor to submit, within a specified period of no less than 5 days from the date of the request, means of evidence concerning the entity to the extent to which the submitted certificate was intended to confirm the absence of grounds for exclusion or compliance with the conditions for participation in the procedure for the purposes of this procedure (if conditions have been specified in the procedure). The provisions of Article 128(2)–(5) uPzp shall apply accordingly. 7) If the certificate loses validity in whole or in part during the procedure, the certificate shall not be taken into account to the extent to which it has lost validity. In such a case, the contracting authority shall request the contractor to submit the appropriate means of evidence concerning the entity to the extent to which the certificate was intended to confirm the absence of grounds for exclusion or compliance with the conditions for participation in the procedure (if conditions have been specified in the procedure). 1. DEADLINE FOR PERFORMANCE OF THE CONTRACT - 14 months from the date of conclusion of the contract, including: STAGE I - within 6 months from the date of conclusion of the contract, STAGE II - within 12 months from the date of conclusion of the contract, STAGE III - within 14 months from the date of conclusion of the contract, The combined performance of the entire scope, i.e. Stages I, II and III, shall constitute performance of the subject of the contract.
