1. The subject matter of the contract is the preparation of design documentation for the development of a recreational area involving the establishment of green areas and a playground on cadastral plot No. 11816/19 in Housing Estate II in Suwałki. 2. The detailed subject matter of the contract is contained in Annex No. 2 to the SWZ – Description of the Subject Matter of the Contract, hereinafter referred to as the OPZ. 3. NOTE: The Contracting Authority informs that it has applied to the Municipal Heritage Conservation Officer for conservation recommendations concerning the works described in the OPZ. The Contracting Authority will promptly make the recommendations received available. In accordance with the attached OPZ, the design documentation prepared must be agreed with the Municipal Heritage Conservation Officer. 4. The contract must be performed in accordance with: 1) the OPZ, 2) the recommendations of the Municipal Heritage Conservation Officer, 3) the Regulation of the Minister of Development and Technology of 20 December 2021 on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works, and the functional and utility program (Journal of Laws, item 2454). 4) the Regulation of the Minister of Development and Technology of 20 December 2021 on determining the methods and bases for preparing an investor’s cost estimate, calculating the planned costs of design work, and the planned costs of construction works specified in the functional and utility program (Journal of Laws, item 2458), 5) the Regulation of the Minister of Development of 11 September 2020 on the detailed scope and form of a construction design (Journal of Laws of 2022, item 1679, consolidated text, as amended), 6) the applicable provisions of the Construction Law (Journal of Laws of 2026, item 524, consolidated text, as amended). - and other regulations: specific regulations, applicable technical conditions, national and industry standards, engineering practice, principles of technical knowledge, as well as other legal acts concerning the subject matter of the contract. 5. With regard to the description of the proposed materials and equipment, the design documentation should be prepared in accordance with Article 99 of the Pzp Act. The subject matter of the contract may not be described in a manner that could impede fair competition, in particular by indicating trademarks, patents or origin, a source or a specific process that characterizes the products or services provided by a particular contractor, if this could lead to certain contractors or products being favored or eliminated. The subject matter of the contract should be described in accordance with Article 101 of the Pzp Act. 6. The technical documentation should take into account the provisions of Article 100 of the Pzp Act, i.e. “In the case of contracts intended for use by natural persons, including employees of the Contracting Authority, the description of the subject matter of the contract shall be prepared taking into account accessibility requirements for persons with disabilities and design intended for all users, unless this is not justified by the nature of the subject matter of the contract. If the requirements referred to in paragraph 1 arise from an act of European Union law, the subject matter of the contract, with respect to accessibility requirements for persons with disabilities and design intended for all users, shall be described by reference to that act.” 7. Whenever in this SWZ the subject matter of the contract has been specified by indicating trademarks, patents, origin, etc., the Contracting Authority’s intention was to present a “type” of product meeting the Contracting Authority’s requirements. Furthermore, it should be assumed that all such indications are accompanied by the words “or equivalent.” Accordingly, the Contractor may offer an equivalent solution that guarantees parameters, technical and quality standards, and functional standards no worse than those indicated in the SWZ. A Contractor relying on solutions equivalent to those described by the Contracting Authority is obliged to indicate in the submitted tender that the supplies it offers meet the requirements specified by the Contracting Authority. 8. The Contracting Authority informs that it intends to apply for co-financing for the project from funds under the Integrated Territorial Investments (ZIT) instrument, on the basis of the design documentation prepared during the performance of this contract. The Contractor is obliged to prepare the design documentation in a manner compliant with the applicable provisions of law, program guidelines, and the requirements necessary for its use in preparing and submitting an application for co-financing.
