Opportunity description

The procedure is conducted in accordance with the provisions of the Act of 11 September 2019, Public Procurement Law (Journal of Laws of 2026, item 793), hereinafter referred to as the Pzp Act. The procedure is conducted as an open tender pursuant to Article 132 of the Pzp Act. The Contracting Authority awards the contract in parts, each of which constitutes the subject of a separate procedure. The subject of the contract is a service for the preparation of design and cost-estimate documentation and detailed design documentation for earthworks and installation works for a container complex. Common Procurement Vocabulary (CPV) code: 71220000-6 Architectural design services. The detailed description of the subject of the contract is set out in Annexes No. 1, No. 5 and No. 4 to the SWZ, i.e.: Tender Form, Description of the Subject of the Contract and Draft Contractual Provisions. The Contracting Authority does not permit the submission of tenders for parts. Justification: Dividing the contract into parts is unjustified due to the specific nature of the contract, additional technical difficulties, costs and risks associated with coordinating several contractors. The decision is optimal from the end-user’s perspective. It is prohibited to specify trademarks, manufacturers’ proprietary names, patents, or the origin of products, equipment and materials in the design documentation prepared. The only exception is where specifying trademarks is justified by the specific nature of the subject of the contract and it is not possible to describe the subject of the contract using sufficiently precise terms. The Contractor is obliged to describe in the documentation the specific circumstances necessitating such an indication and to use the words “or equivalent”, together with the specification of detailed parameters that will allow goods or equipment from other manufacturers to be accepted as equivalent. [Site visit requirements] Due to the specific nature of the subject of the contract, the Contracting Authority requires that a tender be submitted after the Contractor has conducted a site visit. Note! The Contracting Authority will reject the Contractor’s tender if: […] “it was submitted without conducting a site visit or without examining the documents necessary for performance of the contract that are available on the Contracting Authority’s premises, where the Contracting Authority required this in the procurement documents”. The site visit may be conducted on working days from Monday to Friday between 8.00 and 14.00. Contractors or authorised employees of the Contractor may participate in the site visit. Before the site visit, the Contractor should send the Contracting Authority a list of participants 2 days before the planned site visit. The Contracting Authority will confirm in writing, at the email address indicated by the Contractor, whether the site visit can be conducted on the requested date. Rules for entry into the military complex: Entry into military complex K-0044 will take place through the Pass Office, where Contractors will receive passes marked "GUEST"; Contractors should have with them: 1) an identity card; 2) a security clearance for at least the "RESTRICTED" classification level; 3) training in the protection of classified information. The Contracting Authority does not restrict the possibility of applying for the award of the contract exclusively to Contractors referred to in Article 94(1) of the Pzp Act, i.e. those having the status of a sheltered workshop, social cooperatives and other Contractors whose main purpose, or the main purpose of the activities of their organisationally separate units that will perform the contract, is the social and professional integration of socially marginalised persons. [Subcontracting] 1. The Contracting Authority permits parts of the contract to be entrusted to Subcontractors, subject to the Contractor’s obligation to personally perform the key tasks indicated below. 2. Acting pursuant to Article 121 of the Public Procurement Law, the Contracting Authority stipulates that the Contractor (or individual consortium members) must personally perform the following key tasks: 1) Preparation of design documentation regarding the foundation of the containers, including analysis of ground conditions, selection of the foundation technology and preparation of the necessary structural drawings and calculations. 2) Interdisciplinary coordination of all specialist designs relating to the installations necessary for the operation of the containers (electrical and sanitary), in order to eliminate design conflicts. 3) Preparation of investor’s cost estimates and bills of quantities. 3. Justification for the stipulation: The above requirement results from the need to ensure the substantive, technical and functional consistency of the design documentation prepared for earthworks and installation works for a container complex. The tasks reserved for personal performance comprise essential elements of the design process, the proper execution of which has a direct impact on the safety of the designed solutions, the completeness of the documentation and the proper coordination of all discipline-specific studies. Ensuring uniform design assumptions for architectural and structural solutions, earthworks, the sub-base, container foundations and technical infrastructure is of particular importance. Furthermore, performance of the contract involves access to information concerning the infrastructure of a military facility, which requires special security measures and restriction of the group of entities participating in the performance of key parts of the contract. Personal performance of the indicated tasks by the Contractor’s verified personnel minimises the risk of design errors, inconsistencies between discipline-specific studies and unauthorised disclosure of protected information. 4. The Contractor is obliged to indicate in the Tender Form the parts of the contract that it intends to entrust to Subcontractors and to provide the names of the Subcontractors, if already known. 5. If part of the contract is entrusted to a Subcontractor, the Subcontractor and the persons assigned to perform the contract must meet the requirements concerning the protection of information classified as “RESTRICTED”. Persons participating in performance of the contract should possess: 1) written authorisation from the head of the organisational unit to access information classified as “RESTRICTED” or a security clearance; 2) a current certificate confirming completion of training in the protection of classified information. 6. Subcontractors may be entrusted with the performance of the following parts of the contract: 1) sanitary installation designs; 2) electrical installation designs; 3) preparation of specialist expert assessments, studies, opinions and approvals required by law or by the specific nature of the subject of the contract.
