Opportunity description
1. The subject matter of the contract is the construction of a multi-family residential building together with technical infrastructure and site development on an undeveloped property located in Olsztyn at Marii Zientary-Malewskiej/Truskawkowa Street, designated in the land register as plots Nos. 243/9, 246/2, 247/6, 247/7, 247/10, cadastral district 59, with a total area of 0.4924 ha, for which the District Court in Olsztyn maintains land and mortgage register OL1O/00205923/6. 2. The detailed scope and description of the subject matter of the contract have been specified in the design documentation, which constitutes an integral part of the Specification (Appendix No. 1 to the SWZ). 3. The subject matter of the contract must be performed on the basis of the design documentation referred to above, prepared by PAM Pracownia Architektoniczna Paweł Myśliwiec, and the Building Permit: Decision No. II – 45/2026 dated 12.02.2026. 4. The bill of quantities (Appendix No. 1A to the SWZ), which is illustrative in nature, constitutes only supporting material for the preparation of the tender by the Contractor. The Contractor may use it at its own risk to calculate the tender price. Any errors in the attached bills of quantities, e.g. the omission of certain works or an understatement of their quantities, shall not constitute grounds for the Contractor to demand additional payment for the performance of the contract in question. In order to fully price the works, each Contractor is required to carry out a detailed analysis of the design documentation before submitting a tender. Due to the lump-sum nature of the settlement, the bill of quantities is solely auxiliary in nature to simplify the Contractor’s pricing of the works, which the Contractor should prepare on the basis of the design documentation. In the event of discrepancies between the design documentation and the bill of quantities, the design documentation shall take absolute precedence. The absence from the bill of quantities of any elements included in the design documentation shall not constitute grounds for concluding an annex for additional works. If items are found to be missing from the bill of quantities, the Contractor is required to include additional items enabling a reliable valuation of the subject matter of the contract. 6. Any discrepancy in the actual quantity and type of works performed compared with those included in the tender shall in no way affect the remuneration. The Contracting Authority also excludes the possibility of claims by the Contractor related to an incorrectly calculated tender price or the omission of elements necessary for the performance of the contract. 7. Requirements and conditions for performance of the contract: 1) The Contractor must anticipate all activities that may affect the contract price. In connection with the above, the Contractor is required to conduct a site visit in order to familiarize itself with the scope of the works and the conditions for their performance. 2) The (gross) tender price must include all costs related to the performance of the task arising directly from the design documentation, as well as those not included in the design documentation but necessary to perform the task, which the Contractor is required to carry out as part of the performance of the subject matter of the contract, i.e. including, among others: a) preparation of the construction site, including the felling of trees and shrubs and removal of the remains from the felling of trees and shrubs, b) organization of the site and construction facilities, including a place for organizing regular working meetings, c) cleaning works, maintenance of the facilities and construction site (water supply, sewage removal, waste disposal, organization of welfare facilities, lighting, electricity supply, telephone, security, etc.), d) obtaining consents for access to the construction site, organizing a temporary access road to the construction site, and keeping roads in the construction area clean, e) costs of removing and disposing of waste generated as a result of the works, f) surveying services and a geodetic survey of the works performed, g) costs of as-built geodetic documentation, h) preparation of energy performance certificates for all units, i) preparation of an as-built survey of the rooms with respect to area measurements, j) preparation of as-built documentation, k) preparation of operating and maintenance instructions for the facility and the installations and equipment associated with the facility, l) obtaining an occupancy permit for the buildings, m) all fees associated with acceptance of the works and approval of the development for use, e.g. fees for acceptance activities, etc. 8. The Contractor is required to include in the tender the costs associated with utility consumption: water, sewage collection, electricity, and heating of the building (including technological drying of the building) until final acceptance of the building. In the event of a failure causing utility consumption during the period from final acceptance until the premises are handed over to the tenants, the Contractor is required to cover the utility costs according to the meter reading. 9. The Contractor is required to include in the tender the costs associated with supervision by network operators; furthermore, in connection with the need for the district heating connection to be constructed by Miejskie Przedsiębiorstwo Energetyki Cieplnej Sp. z o.o., the Contractor is required to cooperate in this regard with representatives of the aforementioned Company in order to enable the Company to construct the district heating connection in question during performance of the subject matter of the contract. 10. The Contractor guarantees performance of the subject matter of the contract in accordance with the conditions specified in this Specification, the principles of technical knowledge, and the requirements arising from Polish Standards and technical approvals. All materials used to perform the contract must have the appropriate certificates and approvals permitting their use in construction. 11. The Contractor is required to submit materials for approval to the Investor and to the Investor’s designated Investor’s Supervision Inspector, in particular materials concerning interior finishes.
