The subject matter of the contract is the purchase of a service consisting of determining and compiling the data required for inclusion in the Digital Building Logbook (c-KOB), on the basis of paper documentation provided by the Contracting Authority and findings made independently, including with the aid of available and legally sanctioned services (holding data in the field of geodesy and cartography), such as, inter alia, information about the building: • type and function of the building and year it was put into use, • technical parameters (building footprint, height, cubic capacity, number of storeys, number of premises), • installations and equipment, site plan and marking on the map, • information on products containing asbestos and the competent building supervision authority. Providing them to the Contracting Authority in the form of a tool enabling the direct export of data to the government system https://c-kob.gunb.gov.pl/. A detailed description of the subject matter of the contract (OPZ) is contained in the MODIFIED Annex No. 2 to the SWZ. The Contracting Authority provides for the possibility of cancelling the procedure if the Public Funds that it intended to allocate for the performance of all or part of the contract have not been granted to it—in accordance with Article 257 of the Public Procurement Law. The Contracting Authority, pursuant to Article 91(1) of the Act of 11 September 2019—Public Procurement Law, analysed the possibility of dividing the contract into lots. As a result of the analysis, it was concluded that dividing the contract in question is not justified for technical, organisational and economic reasons. The Contracting Authority also assessed the impact of not dividing the contract on competition. The subject matter of the contract is available to contractors that have the appropriate technical and organisational capacity or may apply for the award of the contract jointly or use the resources of third parties, in accordance with the provisions of the Public Procurement Law. Therefore, not dividing the contract into lots does not lead to an unjustified restriction of competition or infringement of the principle of fair competition and equal treatment of contractors. In view of the above circumstances, the Contracting Authority concluded that awarding the contract as a single, comprehensive contract will ensure the achievement of the intended objectives, reduce technical and organisational risks, enable effective management of the implementation of the project, and ensure the contractor’s uniform responsibility for the proper performance of the entire subject matter of the contract.
