Opportunity description

1. The subject of the contract is the supply of chemical reagents for the needs of the Central Laboratory of the Main Inspectorate of Plant Health and Seed Inspection, specified in Annex No. 2, divided into 66 lots. 2. The detailed method of performance of the subject of the contract is specified in Annex No. 1 to the SWZ – Draft contractual provisions and Annex No. 2 to the SWZ – Assortment and price form. 3. Place of delivery: in accordance with Annexes No. 3 and No. 3a to the SWZ. 4. The Contracting Authority is the Main Inspectorate of Plant Health and Seed Inspection, Al. Jana Pawła II 11, 00-828 Warsaw, on behalf of and for which the Government Administration Service Centre, ul. Powsińska 69/71, 02-903 Warsaw, acts. 5. The Contracting Authority does not permit the submission of equivalent tenders in selected lots indicated in Annex No. 2 to the SWZ. The Contracting Authority informs that replacing any chemical reagent and introducing its substitute into the testing procedure requires, in each case, a very costly and time-consuming validation process. This would make it impossible to ensure the continuity of research work, would reduce the efficiency of the Laboratory’s work, which could extend the waiting period for the test result, and would significantly increase the Laboratory’s operating costs. In extreme cases, the validation procedure could demonstrate that the purchased substitute is unsuitable for testing, which would necessitate another purchase and disrupt the Laboratory’s work. The laboratories of the Central Laboratory use testing methodologies generally accepted internationally and in the European Union, requiring the use of specified laboratory equipment of a specified standard and quality (often directly indicated in the methodology). Furthermore, it is necessary to maintain a specified mode of operation by using the equipment used to date (changing it may significantly affect the quality of the results or necessitate re-optimisation of the method). In the remaining lots, whenever trademarks, patents or origin, as well as standards, are used in the SWZ, including in the description of the subject of the contract, the Contracting Authority permits equivalent trademarks, patents or origin, as well as equivalent standards, provided that the items offered by the Contractor have the same or better quality parameters. 6. The Contracting Authority does not envisage awarding contracts referred to in Art. 214(1)(8) of the Pzp Act. 7. The Contracting Authority does not envisage conducting the electronic auction referred to in Arts. 227-238 of the Pzp Act. 8. The Contracting Authority does not permit the submission of variant tenders within the meaning of Art. 92(1) of the Pzp Act. 9. The Contracting Authority permits the submission of tenders for individual lots. Each Contractor has the right to submit a tender for one or more lots of this procedure, described in Annex No. 2 to the SWZ. 10. The Contracting Authority does not envisage concluding the framework agreement referred to in Arts. 311-315 of the Pzp Act. 11. The Contracting Authority does not envisage reimbursing the costs of participation in the procedure. 12. The Contracting Authority does not permit the submission of tenders in the form of electronic catalogues or the attachment of electronic catalogues to the tender. 13. The Contracting Authority may cancel the contract award procedure if the funds that the Contracting Authority intended to allocate to financing all or part of the contract have not been granted to it and the possibility of cancelling the procedure on this basis was provided for in the contract notice. 1.
