Opportunity description

1) The subject matter of the contract is the successive supply (in batches depending on needs) of chemical reagents. The anticipated range and quantities of reagents are specified in Appendix No. 2 to the SWZ – Detailed description of the subject matter of the contract/Range and price form, subject to the provisions of point 5 below. 2) The reagents offered must be brand new and come from current production (i.e. manufactured no earlier than 12 months before the date of acceptance of the subject matter of the contract) and must have a shelf life of no less than 12 months from the date of signing the acceptance protocol, except for those chemical reagents for which the manufacturer has stipulated a shorter expiry period. The reagents should be free from physical and legal defects and have all relevant certificates and attestations confirming that the supplied product is authorized for sale in the territory of the Republic of Poland. 3) The scope of the contract includes: delivery of the reagents, their transport, unloading and carrying them into the place of destination. 4) A detailed description of the subject matter of the contract is provided in Appendix No. 2 to the SWZ; 5) The subject matter of the contract, specified in Appendix No. 2 to the SWZ, was prepared on the basis of an analysis of supplies made during the last 12 months as part of several dozen research programs being conducted, the continuation of which requires the absolute use of reagents from the same manufacturer. However, an analysis of supplies carried out in previous years shows that predictability (repeatability in terms of quantity and range) is at a level of approximately 40%. This is because it is often necessary to change reagents during the research being conducted. In view of the above, the Contracting Authority reserves the right to change the quantity of the specified subject matter of the contract with regard to the type (range) listed in Appendix No. 2 to the SWZ, as well as to limit the subject matter of the contract due to needs that the Contracting Authority is unable to predict precisely at the stage of the procedure being conducted; furthermore, under the contract, the Contracting Authority will be able to purchase reagents other than those specified in Appendix No. 2 to the SWZ, belonging to the same category, provided that the total value of the reagents ordered does not exceed the contract value determined on the basis of the accepted most advantageous tender; 6) The basis for determining the price of reagents not included in Appendix No. 2 will be the net prices, current on the date the Contracting Authority places the order, of products available in the Contractor’s range and price catalogue (price list), specified in PLN and taking into account the discount offered on net catalogue prices; 7) The Contractor is obliged (in the case of a range not listed in the price form) to provide a link to the reagents website (online) where the Contractor’s current range and price catalogue (price list), applicable during the contract performance period, is available, as well as a login and password if required by the website. The Contractor will immediately inform the Contracting Authority at the specified email address of any changes concerning the catalogue and price promotions; 8) In the case of a promotional price (special offer for reagents), the basis for determining the price will be the promotional (special) price, provided that it is more advantageous than the catalogue price taking into account the declared discount. Promotional (special) offers will also apply to the reagents listed in Appendix No. 2 to the SWZ. 9) The Contractor will perform the Subject Matter of the Contract according to the Contracting Authority’s current needs for a period of 12 months from the date of conclusion of the contract or until the Contract value is exhausted, if the contract value is exhausted before the expiry of 12 months. 10) The Subject Matter of the Contract will be performed in batches, on the basis of orders specifying the type and quantity of reagents within a given batch. 11) Delivery deadline for the ordered batch of reagents: - maximum delivery deadline: up to 42 days from the date the Contracting Authority places the order; the Contractor may shorten the delivery deadline in relation to the required deadline indicated above. A tender providing for a shortened delivery deadline will receive points as part of the evaluation of tenders using the criterion for selecting the most advantageous tender. - in the case of chemical reagents requiring the relevant permits, i.e. narcotic substances, substances of strategic importance, ozone-depleting substances, etc. – the Contractor will deliver and unload them within no more than 28 days from the date the above-mentioned permits are delivered to the Contractor. The Contracting Authority stipulates that a given order may be performed after the expiry of the Contract term referred to in point 1 above, provided that the Contracting Authority sends the order within the Contract term. In such a case, the Contractor is obliged to perform the order and is not entitled to any claims on this account. 12) Delivery address: Uniwersytet Śląski w Katowicach, ul. Bankowa 14, 40-007 Katowice; or another location indicated in the order by the UŚ Supply Management Department (including, in particular, other units of the Contracting Authority in Katowice, Sosnowiec and Chorzów); 13) Required minimum warranty period: A quality warranty should be provided for a period of 12 months from the date of signing the acceptance protocol, excluding those reagents for which the manufacturer has stipulated a shorter expiry period. 14) Invoice payment period: 30 days. 15) The detailed conditions for performance of the contract and the payment terms are contained in the draft contract constituting Appendix No. 3 to the SWZ. 16) The Contracting Authority does not envisage awarding contracts for additional supplies within the meaning of Article 214(1)(8) of the Pzp Act. 17) No market consultations were conducted before the initiation of the procedure. 1) The subject matter of the contract is the successive supply (in batches depending on needs) of chemical reagents.
